BY LISA FLEISHER DAILY NEWS WRITER Nearly 200 of New York's most loathsome sexual predators get free Viagra courtesy of Medicaid - a policy one elected official called "mind-boggling" yesterday. The paroled offenders, and likely thousands more deemed less dangerous, get reimbursed for the impotence drug with taxpayer money, according to state Controller Alan Hevesi. He called it an unintended consequence of a 1998 federal mandate requiring state Medicaid programs to pay for Viagra. "We think this is a matter of serious public policy that ought to be reviewed," Hevesi said. "I would not allow anybody on a sexual offender list to have subsidized medications that increase their ability to commit crimes and their urges to do so." Acting on a tip during a routine review, Hevesi's office verified 198 names from an Internet list of nearly 7,400 Level 3 offenders from the past five years that matched those getting Medicaid-sponsored Viagra. Level 3 offenders are convicted sexual predators who, courts have determined, represent a high risk to public safety. Under Megan's Law, their photos and addresses are public record. The Viagra recipients' crimes, against victims ages 2 to 90, ranged from first-degree rape to sexual touching. Sen. Chuck Schumer (D-N.Y.) warned that if the federal Department of Health and Human Services didn't act quickly, he would offer a law guaranteed to pass. "It is just mind-boggling to think that Level 3 sexual offenders can get Viagra, which may indeed help them perpetrate further horrible crimes," he said. "And what we know about Level 3 offenders is ... They're almost never rehabilitated." Sen. Hillary Clinton (D-N.Y.) and state Sen. Dean Skelos (R-Nassau), a sponsor of New York's Megan's Law, also issued statements ripping the policy. There are also probably thousands of Level 1 and 2 offenders using Viagra, or two similar medications approved by Medicaid: Cialis and Levitra, Hevesi said. "To the extent that might be unfair to [freed sex offenders], you balance that with the potential danger and damage to the victims," he said.
