thoughts and a question on 2257

So I'm reading through this stuff and not yet getting my panties in a bundle because we don't yet know exactly what the law looks like until it is published but I came a cross a couple things I thought were interesting. I'll be asking a lawyer about this stuff and other things that pertain to me when the law is published, but just wanted to post to get peoples thoughts on these things. So first is the the part on the FSC PDF that says " Retroactive application: Content acquired before new new regulations. Compliance apparently required if content content ?published? after after effective date. Republication occurs every day online." So I wonder does this mean that everyday they consider the website to be republished? So I've build a site that has sat, untouched, since 2001 they will consider it being republished everyday so it now falls in the new record keeping system? Second is this part that says: " Records for performers portrayed after effective date must include: Compliance form with legal name and all other names. Copy of the depiction. If on the Web; a copy of any associated URL." Now if I'm reading this correctly this means not only will I have to have that for my site, but so will the content producer. So I wonder how many producers out there have sold 100's if not 1000's of CD of content that is now spread all over the web and they have no way of tracking down every url. One last thought. I could make a site, have all the 2257 docs for the site and everything in line and then some guy can come along, snag my galleries and pics in them and post them on a free host ( this happens all the time already ) and I have no control over them, and, often, no knowlege that this has happened. so there will still be countless images published everyday with little or no way of keeping track of them. |
