The first conviction for felony spamming has been recorded and the judge in the case, Loudoun County Circuit Judge Thomas Horne, took a no-nonsense approach, sentencing Jeremy Jaynes to nine years in prison for sending out bulk e-mails. The sentence has been postponed pending an appeal by Jaynes.

The nine-year prison term matched the recommendation made by the jury when it found him guilty in November. Jaynes used false Internet addresses to send mass-mail ads through American Online (AOL).

The law in Virginia makes it illegal for people to send bulk e-mails that are unsolicited while masking the origins of the e-mail.

Some of the products Jaynes advertised in his spam e-mails included fake items like a 'FedEx refund processor' and pornography.

Before he was sentenced, Jaynes told Judge Horne that, 'I can guarantee the court I will not be involved in the e-mail marketing business again' regardless of the outcome of his appeal.

According to prosecutors, at the time of his arrest, Jaynes was one of the top 10 spammers in the world. Now it is clear that this kind of spam left a bitter taste in his mouth.

It would be nice to see them go after programs that actively solicit and pay spammers to mail for them.

they will make him sign a gag order and he wont bea ble to talk about his case to anyone
they are just making an example out of him for the media

Its not really going to stop anyone from mailing and especially not mailers who don't live in the us

This was more of a case of fraud. Spam is just a fun buzzword. Its the scams that were part of the email that put him in deep shit.

read into it a little more. we wasn't just a spammer. he was scamming people. there is a huge difference. he just happened to be running his scam through spamming.
