Patent Question

Hypothetically, if we owned a patent as a company and, the idea for that patent was used in a national TV show, could we take legal action against the producers of the said show?

Hypothetically, if you owned a patent as a company and that patent was used by anyone and you neglected to enforce the patent shortly after finding out about infringement, you'll lose the rights to the patent. As a patent holder, you have that responsibility assuming you want to keep your rights.

At least, that's the way I understand patent law to be in north america. Your milage may vary. You might want to check with a lawyer.

Thats my understanding of the law to however, im not sure if the working breach of the patent has to actually 'work' or whether the concept of it alone is enough to warrant action.

Also, dont know where we stand so far as the 'tv show' angle goes.

Unfortunately i have a few more hours before our attorney is awake to findout for certain so i figured id ask the GFY keyboard lawyers for shits and giggles ;)
