FUCK! 5 days ago my gf got in a wreck, 2 hours ago so did I! - Legal Question Inside.

neither of us were at fault. a 16 year old kid pulled right out in front of my gf 5 days ago and there's no question about that, he was cited and is gonna owe some good money, she hurt her arm / shoulder / neck a bit.

tonight i was with her and i was driving... GREEN LIGHT at an intersection and i noticed as usual, some jackass nearing a bit too close looking to take a left turn, however since I have the green light I'm assuming he ISN'T GOING TO GO... last second... he pulls out, nothing i can do, slammed the breaks and hit directly on his back wheel - all of us were fine but my car is basically irrepirable.

however, no one stopped to witness what happened... the guy lied and said he had a green turn arrow clearly, which is fucking bullshit cause mine was green.

so basically there are 2 contradicting statements, but the evidence of my skid mark clearly shows im trying to avoid it and he was probably trying to rush it.

my question is, how will this probably play out amongst the car insurance companies? i have a clean driving record, i don't know about this guy though.
the 2 troopers both told me they think he's lying because of his body language / answers, "but only the facts matter in court".

this year has been horrible all around in every aspect imaginable.

I can only tell you what the laws are where I am. Here in Manitoba, according to MPIC, the guiding force in a decision like this is whose vehicle changed direction the most. Since he commited a full left turn at the time of the collision, here he would be deemed 100% at fault, assuming you had a gree light and he had no flashing green arrow.

There may be a similar guideline where you are, it's worth inquiring about.

Most likely each insurance company will pay for it's insured client since their are no witnesses and 2 conflicting stories

in a rear ender the car in the back is always wrong.. Unless he was breaking some law to put his car in that place ( i.e. changed lanes without signal )

Usually, the guy making the left is at fault, but since you hit the rear portion of the vehicle, they will claim you were either travelling too fast to stop in time or you weren't paying enough attention to the road blah blah blah.

50%/50% at fault, you both lose. Enjoy your higher insurance premiums! (I had the same thing happen to me 7 years ago, I am finally back to regular insurance rates).
