Servers are getting fucked by the GOV

First off, I would like to let the trades and gallery submitters to know that Lostbush TGP has been down a very large part of the day. So please have patience while a particular problem is resolved.

Many other sites from other webmasters and a few hosts have been affected by this because of whats going on right now - Read: http://www.customs.ustreas.gov/121101f.htm

Apparently our great gov has shut down a facility with many hosts and servers are affected. This totally blows. Just because of software piracy and warez crap our businesses are going out the window. I am hopefully going to find out were opinions can be voiced and hopefully these voices heard by the ones that decide they can just shut shit down.

Think of it this way, if large plaza with stores was shut down for a day because they are investigating one store for some crime. Would anyone stand for this?

I think not. All they had to do was shut down the domains that are involved. Its pretty obvious which ones pirate software or do warez shit isn't it? Just go to the sites.

So again because of dishonest assholes that are no better than common thiefs, those that refuse to play a part in this bullshit get fucked over.

Thanks again Mr Mother Fucking Cheater Thief!

Actually, the businesses that knowingly supported piracy are being punished. I completely support the governments actions as I am sure most Americans do.

[SNIP]
"Operation Buccaneer targeted the WAREZ community, a loosely affiliated network of software piracy gangs that engage in the duplication and reproduction of copyrighted software over the Internet. It is estimated that the WAREZ community is responsible for nearly 90% of the Internet sites that offer pirated software."[/SNIP]

If the servers were allowing it, (and we all know they were) then they deserve to be shut down. It boils down to... if you're gonna share your software, don't do it in public out in front of the police station AND... AND... expect to make a profit off it. (pretty bold if you ask me)

They played the game.... and now they'll have to pay the dealer.

"The software pirated by these groups included expensive business software, firewall and other security software, and

Who needs APIC when you have US Customs! This is cool!

Thanks all. Keep in mind though that this is no joke. If you decide to run a server and happen to lease building space with others that get involved in this, it could happen to you. The host I was on has no connection with the hosts that are under investigation, other than being in the same building.

This is what burns me up. And that point seems to be getting past most of you

Yeah this seems shitty... the govt's way of dealing with things is just take all the computers and then ask questions later ;) Then I think they pay an entire team of people to look through all the files... more wasted taxpayer money...

Too bad most of the "warez" people are probably still in middle school... I don't see how these warez guys made any profit either... that HTML page makes it sound like these warez people made billions of $$$ of piracy....?

I was really suprised to hear radio ads in LA about all the amazing penalties (how many years in jail?) for having unregistered software... There must be a lot of money backing up this government crackdown -- maybe it will stimulate the economy if the rest of the world is actually paying for our hard work instead of just mooching off of us. No offense to other countries (like Canada that produces all the cool 3D software) but most of the software in the world comes from the USA...

blah blah blah...

Anyone know which hosts were affected by the crackdown? Not talking about guilt/innocence, but if datacenters are being shut down, hosts have got to be affected.

I run a free host and am a director of XXXHostit.
We lost all our servers to these mindless jerks.
We have never been involved in the warez scene and we run a very tight ship with our hosting company...or should I say what was our hosting company.
Thanx to the government we are now out of business....2 years of sweat and bending over backwards to provide a good service, thrown out the door all because of there mindless heartless actions.
Our lawyers are currently negotiating to get our servers back, why should we have to do that, we are an innocent party that got caught up in something that we had no idea of untill the articles started popping up on news websites, they wouldnt even tell us what was going when when they were removing our servers....so much for a democratic society.
They should target there actions towards the offenders, not every tom dick and harry thats unfortunate enough to be on a network thats being shared unknowingly by those warez freaks....I am very upset and feel ill, one day I'm happily running a good legitimate business and the next I get my feet kicked from under me.
Anyway...I better sign off now because the more I type the more upset I get...maybe I will wake up soon and realise it is all a bad dream

heres hoping

If you choose to deal with the periphery in this business, you leaver yourself wide open. If you deal with a reliable well established host, things like this don't happen.

I am strongly considering a class action lawsuit to recover damages. If anyone lost significant amounts of money and would like to join me in this suit please feel free to email me. I estimate my two day losses at around $1500 with an additional thousands of dollars lost in the future due to my archived traffic being wiped away.

maybe the gov't is gonna start shutting down backbones because of this. it's unbelievable, the lengths that the government will go to get so few people.

is it really posible to shut down ever warez operator? NO.

then why all this action? to show the people that they can get someone after so many years. it's a simple scare tactic hoping that they can scare the little guys before they get big, the same thing APIC was doing.
but how are you gonna stop an employee from hosting a warez server be it FTP, hotline or whatever. now you entire business is gonna shut down.

i wonder if any of this has to do with the top secret workers at area 51 on stike because of wages and overtime

if you don't know what your employees are doing with your servers, you deserve to be shut down.

I'm glad I could make your day.

In all seriousness a lot of innocent people were affected by this. I do TGPs full time and make a very nice living. I also have a full time employee who just came aboard and we have paid for office space. Now for the last 48 hours I've been sitting on my hands watching my losses mount up. Why? Because someone wanted to be cute and start some lame ass warez group.

If you don't think we have a case you are certainly entitled to your opinion. However, my losses are rising and I imagine many others are in the same boat. Every day that I'm down another batch of my galleries get deleted from link lists and TGP archives. When this happens my future revenue falls even more.

Some may not think this is a big deal but if you lost your sole source of income and 30% of income for the next 90 days it may be different.

I'm not unsympathetic to your loss but calling for a class action suit is a lot less productive than going out and defending your business from this happening again.

I am not unfamiliar with the loss of major revenue streams, I've just found that repairing your business works better than screaming for a law suit.

Why not do both? A damages/loss of income suit such as this (or the one that I have going) takes ages to work out, especially when there are criminal charges to be dealt with. Begin rebuilding your businesses based on a more diverse model, maybe use space on entirely different servers.

In the meantime, launch the suit and wait it out. What will likely happen is that the police will have to take months and months to pour through all the data from all the servers they've grabbed before they can prove one way or another that anyone is really guilty of anything. You can launch your civil suit against them, but it would likely be stayed until the criminal warez thing is determined (which will take a long time, months and months at the earliest).

BUT, once that is dealth with, and it is proven by THAT case that you are innocent, then there's the matter of your civil suit pending, right? That's when you nail them for all sorts of damages, punitive damages, damages to your life and livelihood, whatever your lawyer can think up too. The fact is, when fucking asshole cops make their big "grab for glory" like this, there are ALWAYS innocent law-abiders that get sucked into the vortex that is the police ego. "Arrest em and fuck their lives, and let God sort it out" -- fucking asshole cops.

However, I agree with 12clicks that no one should put all their hopes into a civil suit, I would (and did) begin rebuilding the business right away. Build it bigger, better, more diverse than before, thus more solid. Don't keep all your sites on one server, and don't make all your sites for the same niche market, so that if one source of income craps out like this one did, you still have 10 others pumping money to you.

And don't give up hope. That alone nearly killed me off last year.

As they say, don't put all your eggs in one basket/nest.

Setting up a DNS load balancer with a mirroring system takes less than half an hour and will make sure your site is up even if one of your servers is down.

A host that does not have their own data center should always consider using more than one data center just in case, there are many things that can cause downtime besides servers being seized.

With a valid search warrant the police can and is allowed by law to take anything that they have reason to believe is evidence and are allowed not to give it back to you since you may destroy the evidence.

Correctamundo.

But the really stupid part about cops and internet crime is that it takes only a short while to make an exact copy of someone's hard-drive. The ONLY reason that cops tend to keep your box is because it looks better in court. Beleive me, I asked about this and that was the best answer they could give me. Maybe one day a wise old judge will say "why did the prosecution have to keep the entire computer? An exact copy of it on CD's would suffice, are you all stupid or what?"

Alas, a judge will never say that though, they already know the answer to the question.

Instead of sitting on your hands, and watching your losses climb - get a new host.

CaveCreek is up, ISPrime is up, LikeWhoa is up, Dynamic Hosting is up, ServInt is up, High End Media is up, National Net is up, Silicon Vallery is up, Candid Hosting is up...

I'm sure you can find many more hosts that aren't having this problem. I can understand your frustration. I have found myself feeling helpless at times of duress. Trust, not taking action will really hurt your business.
