Why not do both? A damages/loss of income suit such as this (or the one that I have going) takes ages to work out, especially when there are criminal charges to be dealt with. Begin rebuilding your businesses based on a more diverse model, maybe use space on entirely different servers.
In the meantime, launch the suit and wait it out. What will likely happen is that the police will have to take months and months to pour through all the data from all the servers they've grabbed before they can prove one way or another that anyone is really guilty of anything. You can launch your civil suit against them, but it would likely be stayed until the criminal warez thing is determined (which will take a long time, months and months at the earliest).
BUT, once that is dealth with, and it is proven by THAT case that you are innocent, then there's the matter of your civil suit pending, right? That's when you nail them for all sorts of damages, punitive damages, damages to your life and livelihood, whatever your lawyer can think up too. The fact is, when fucking asshole cops make their big "grab for glory" like this, there are ALWAYS innocent law-abiders that get sucked into the vortex that is the police ego. "Arrest em and fuck their lives, and let God sort it out" -- fucking asshole cops.
However, I agree with 12clicks that no one should put all their hopes into a civil suit, I would (and did) begin rebuilding the business right away. Build it bigger, better, more diverse than before, thus more solid. Don't keep all your sites on one server, and don't make all your sites for the same niche market, so that if one source of income craps out like this one did, you still have 10 others pumping money to you.
And don't give up hope. That alone nearly killed me off last year.
