for those of you who aren't sure about contracts
An icq message is NOT A LEGALLY BINDING CONTRACT... nor is a message board post.
Sure, they're proof that you may have said something, but it's not a contract. It's not an oral contract, it's not written, there is no signature. For anyone who doesn't know this, they shouldn't be in business, for anyone who has a lawyer and still doesn't know this.... find a new lawyer. A contract is providing goods or services in exchnage for money or something else. Keywords here is "in exchange for". how those terms are established can vary. Normally it is a written document of somesort. It matters were you are and what court you stand before. Contract law is a whole field of study. So broad statements made by lay people don't mean much. Actuall statements made by lawyers often don't mean much. It's what the court decides when someone drags your ass there. I'm not an attorney, but have paid several and watched many that play one on TV. This post is worth exactly what you paid for it.BTW Boston Legal is on tonight. |
