I thought assets aquired prior to marriage don't get split in half... so if you have the house paid off before marriage, she willl have hard time getting any of it...

If however you put 10% down, and then marry and divorce her, 10% will be yours, rest will be split in half...

but like everyone said, consult a lawyer in your area...

DarkJedi, if you think marriage isn't already a legal contract binding finances, you're naive. What's romantic about binding finances and legal mumbo jumbo? Why is that neccessary? A prenup is simply figuring out how the contract will work for YOU.

Everyone signs a contract. You may as well make it custom to your liking. Don't let anyone fool you into thinking it's anything else.

well, there's lots of variables here, nothing is cut and dried.

1. depends on the state
2. depends whether the divorce is contested, or uncontested
3. depends on spouse share of equity within the house, i.e. who owned it first, what is the split of time of ownership, who put most money into it, etc.
4. depends on how good your attorney, (if contested divorce)
5. depends on the what the judge decides
6. depends on prior agreements (prenups, trusts, etc)
etc, etc.

conclusion, the wise person with equity gets asset protection in place before marriage, he thinks with the big head first, because in life shit does happen.

the the honorable person is fair in the settlement to his wife, especially is she bore him children.
