Spyware laws does conflict with existing contract law doctrines.... However, given how many spyware apps get the 'permission' of users, prosecutors can always claim PROCEDURAL unconscionability (and in the case of spyware that do mass mailing, SUBSTANTIVE unconscionability). Should be interesting how things play out.
