Dvdsforabuck FINALLY gets knocked off by a bunch of thieves! (DRAMA Unfolds!!)

After having operated Dvdsforabuck.com for almost 1 year, someone finally decided to knock off our model.

http://dvdsforapenny.com/

Don't get me wrong, I'm all about friendly competition, in fact it often generates innovation in which the involved parties can benefit from. However, IMO these guys did a BAD job at creating a competing product.

First of all, they're clearly stealing a lot of our copyrighted verbiage. Their membership model charges the same as our but they don't provide the surfers with a FRACTION of what we've always provided.

However, I'm not going to sit here and hate on the wankers .. besides, their affiliate program pays 50% LESS than ours! Also, with Dvdsforabuck Ver. 2.0 coming soon, they can GO FUCK THEMSELVES!!

So if imitation is the sincerest form of flattery, then I guess you're all up in our nuts. You're stealing my exact verbiage in various locations. We didn't create something new, mainstream has been doing this 40+ years. However we did apply new membership concepts to give surfers a better value hands down:

Columbia House offers users a selection of DVDs, 5 for $.49 each plus s/h. The catch is they require members to purchase 5-6 more titles at regular price within 2 years. This puts membership at about $100-120 for the commitment.

Dvdsforabuck offers users a choice from 1000's of brand new dvds, sealed from the studios, and their first 5 for $1 and free shipping. User are then enrolled into our No Long Term Monthly membership fee of $34.95 per month. This puts membership commitment at exactly $1 + $34.95

Really the point is that we've always anticipated competition. What is sad though is when a company appears into the Industry and steals directly from another site owner. By the way, do you run other programs? In the past?

I would certainly think twice about trusting you with my traffic/money since it's clear you have little regard for your fellow site owners/webmasters.

Watch which bridges you burn.

So a member pays 35 bucks a month untill they cancel? What do they get with their membership, movies at a discounted price?

i've seen sites billed by sgada telling the surfers they are getting charged for $1 but the actual charges are annual, so 4 years purchase is $48

for the case of dvdsforpennies its more visible in their terms box which you have to scroll has:

1. When I become a Subscriber I get 4 Dvds for 1¢ which includes free shipping and handling.

2. As a Subscriber I understand that I will receive 4 Dvds for every month that my Subscription continues. There is never any charge for the shipping or handling of the Dvds which are "included" in my Subscription.

3. After the first month of my Subscription, I may cancel my Subscription at any time. I am under no further obligation.

4. dvdsforapenny warrants the Dvds to be free of material defect and agrees to replace them if they are returned within 30 days of their receipt by the Subscriber.

5. I acknowledge and agree that all disputes will be handled by the Subscriber and dvdsforapenny. dvdsforapenny highly recommends and encourages Subscribers to contact dvdsforapenny with any disputes.

6. I also agree that my monthly subscription begins immediately and I will pay $34.99 per month for my Subscription.

7. I agree that if there is any charge associated with being a Subscriber which results in a charge back to dvdsforapenny I will be liable for a $150 processing fee per incident and/or the value of the charge back.

I'm not a hater, but I strongly believe the charges should be visible to the surfer without having to dig the whole site.

I would certainly think twice about trusting you with my traffic/money since it's clear you have little regard for your fellow site owners/webmasters.
This is from the DVDSFORABUCK website:

"As part of your monthly membership fee of $34.95, you will receive 2 selection credits for FREE DVDs every month, with FREE shipping!

Also, if you want the Adult DVD Special Selection, do nothing, it will be sent automatically. You will always have at least 10 days to decide. If you ever receive an unwanted Adult DVD Special Selection, just return that package unopened within 10 days, and you pay nothing! "

Implies that the cusomer gets 2 DVDs every month delivered to them for the $34.95.

WRONG! From the terms of service at their site:

"2. When my first 5 Dvds are shipped, I understand my Membership begins and that I will pay $34.95 per month for Membership dues for each month's Membership.

3. As a Member of the Club I understand that I may choose two movie titles which sell for $19.99 or less or one movie title which sells for $19.99 or more for every month I am a Member of the Club. There is never any charge for the shipping or handling of the movie titles which are "included" in my Membership.

4. The right to choose and receive the monthly movies included in Membership's terminate at the end of each month and may not be accumulated or used later. Monthly movies must be chosen each month. I understand that in the event I fail to choose my monthly movie(s) I will lose my right to choose them in future months or at any other time. I will not be given credit the next month and I will not receive a refund or reduction in monthly Membership dues. The Club highly recommends and encourages Members to use and enjoy their benefits each month.

5. About once a month (around the 15th) I will be shipped and billed for the Director's Favorite of the Month ("Director's Favorite") for the low price of $11.99. I understand that I will not be charged for the Directors Favorite if I ship it back to DVDs for A Buck unopened. I understand that if I open any Directors Favorite I will be charged for the movie whether or not it is later returned, unless defective.

6. When I receive my 5 DVDs for a $1, I may return them unopened within 10 days. If I am not completely satisfied for any reason, I may return the selections, provided the return is dated within 10 days of receipt, at the Club's expense and the Club will credit my account in full. There is no further obligation. I may cancel my Membership at any time.

7. You acknowledge and agree that all Membership disputes will be handled by the Member and the Club. The Club highly recommends and encourages Members to contact the Club with any disputes. As a Member of the Club, Members are offered a money back guarantee providing the Club receives any and all merchandise unopened for the said dispute. Any charge associated with being a Member which results in a charge back to the Club will be liable for a $150 processing fee per incident and/or the value of the charge back."

Read that carefully. The customer gets "credits" which DO NOT accrue. Plus they get charged $11.99 for the selection from them.
So basically it looks to me as $45 for a DVD per month for the customers that don't remember to go back and pick what the want each month.

We ship 4 DVDs every month no questions asked. The customer actually receives 8 DVDs in their first shipment. 4 for the penny plus the 4 from their first month's membership fee. All for the LOW LOW price of $35. No fuss, no muss. When the customer wants to discontinue the service, they can, but we ALWAYS make sure the deal is fair from our end.

For anyone having trouble reading. It's very clearly stated on the FRONT PAGE of the www.dvdsforapenny.com site that the there is a monthly charge. We are NOT in the chargeback business.

This brings up bad memories about Columbia House. I couldn't cancel and they kept sending me shit like Bobby Brown and New Kids on the Block. When I refused to pay, they threatened to send me to collections.

Those fuckers get serious about their $30.

Nick_Moneymaker, the point of the post is that you are stealing directly from their site. You have stolen the "verbage" that belongs to them. Do you know what "verbage" means?

Where's the number 1 from the TOS? Regardless, you or whom ever, blantantly ripped off the "verbage" on their sites. How creative is that? Not very. The point seems to be lost on you.

Duck it all you want, but the fact of the matter is that you stoled directly from their site.

Ok a couple of quick things here.

First off, yes it is GFY so smartass funny guy answers are ok to use at times, but no they are not taken very well when you ignore bad biz practices asked by someone.

You are being accused of stealing wording from a competitors site, someone who is known and respected within our industry. Most people would want to defend their company and explain their side of the story as it pertains to the allegations on hand.

I think if you are wanting support from others in the industry you would address the issue at hand to show you do have proper biz skills. That way others will then believe in your product, it shows where you stand and people will then want to push you.

Also just for the record your sig is to big as well.

How are you making money off selling DVD's for a buck?
Just curious. Thanks.

They're not really a buck.

BossDVDs,

I don't understand what you bitching about.
I have been running DVD stores way before you thought about a DVD and let me tell you everytime we came out with a new idea, we had other sites copied us.
This is just normal practice of biz. Get use to it and just focus on your own business and you'll be OK.
I know this business from inside out and I know what I am talking about.

Good Luck

Those fuckers get serious about their $30.
hahaha! Well if they have 100,000 people paying $30 that's 3,000,000. So they're looking at the big picture.

Two DVD credits they can use to redeem within the members area and it includes free shipping. Also, as part of the club, they're allowed to purchase additional titles at upto 60% off retail.

Where's the number 1 from the TOS? Regardless, you or whom ever, blantantly ripped off the "verbage" on their sites. How creative is that? Not very. The point seems to be lost on you.

Duck it all you want, but the fact of the matter is that you stoled directly from their site.
Exactly my point! I'm not upset that someone is competing with us. Just be a little more creative than STEALING directly from us.

4 for a Penny would give you 400 for a dollar. No?

So it's (given the member pays $35 per month) DVD's for 17.5 bucks with the right to discounted DVD's for the life of the membership?

AVM, I'm not looking for "aid" or "rescue" .. I'm just pointing out that a company has decided to finally knock off our adult DVD Club affiliate model (which I actually expected sooner!) BUT... and a BIG BUT .. they have stolen EXACT verbiage from all over my site... that is illegal. Even more, it appears like they don't even give a fuck. They're too concerned about defending themselves with the assertion that I'm bitching about competition .. I'M NOT, I AM bitching that they stole my shit. They are thieves, plain & simple. As I said before, I would be VERY careful trusting this or any business that resorts to stealing especially from it's neighbor.

Also, I will say again, we are NOT the first DVD sponsor on the net. Companies like http://gamelink.com have been around much longer than Dvdsforabuck. However, our model is based around the Introductory offer will a "commitment" type membership. We created a different, cheaper billing cycle for the user but which the user benefits more from. At the same time, we've been able to reward our webmasters will the highest possible payouts on time every time.

To be exact, a member of Dvdsforabuck pays $1 for 5 dvds (of their choice) BUT "the catch" is they become a member for at least 1 month. The monthly membership costs $34.95 and provides the member with a few benefits. One benefit is that they are allowed to redeem 2 free dvd credits every month and we pay for the shipping. Another benefit is like you mentioned, the ability to access our discounted DVD vault. A few other benefits exist as well with MUCH more on it's way.
