Two interesting court cases recently

1. A man on probation from a CP possession conviction kept a diary that contained fantasy descriptions of brutal CP acts. He was charged with possession of CP for the material in his diary -- stuff he wrote himself and didn't distribute to anyone.

2. Texas supreme court has upheld laws outlawing homosexual sex acts -- acts which are perfectly legal when engaged in with a member of the opposite sex (e.g. anal and oral sex). The claim is that the laws help maintain community standards of decency.

I'm appalled by both decisions. The first seems to be the same as charging someone for what they are thinking.

The second raises all sorts of interesting possibilities. For example, what if a guy gets blown by a TS whore -- but the guy thinks that "he" is a "she"?
I would hope the decision would be overturned by the US supreme court, but with hypocrites like Clarence voting against anything that smacks of personal freedoms, the decision could come down the other way.

I heard of the incident in number 1. I thought the guy got off(no pun intended)because it was his 1st amendment right to record his personal thoughts, feelings and fantasies. But i'm not sure. I know one of those late night shows was discussing it. Maybe it was Politically Correct.
Number Two case and sodomy (pun intended) is upheld in more places than Texas. Maybe not as just a Homosexual thing. Anal sex is against the law in some southern bible belt states. I think Fellatio is as well. Weird, I hear now that Sodomy could be interpeted in more ways than just anal sex. It could also be for vaginal penetration. Lawyers are always thinking of new shit.

The problem for the guy in case # 1 is that he plead guilty -- there wasn't a trial. The article I read said something about the ACLU wanting him to change his plea -- I didn't know you could do that.

Make no mistake -- CP is bad. I didn't know until reading the CP thread tonight and tracing a few links that there is an active "non-nude" world out there with galleries of underage girls -- and that there are paysites for this stuff. Hard to believe.

But -- I don't think it should be illegal to think about CP or even write stories about it for oneself.

BTW -- are stories about CP illegal? I thought you could write just about anything.
