Nastydollars not accepting TGP traffic?

Sorry if this is old news or posted about to death before but with no search function....

Just flicking through the TOS of nastydollars in a quiet moment and came across this...

11. AGE VERIFICATION
The SITE takes a strong stance in favor of preventing minors from accessing sexually-oriented materials. Accordingly, all images, web pages, or tours depicting sexual activity must be protected by some form of legal age verification. Therefore, the SITE adopts the following policies with regard to online age verification: (1) Webmaster must prevent users from accessing images depicting sexual activity (i.e. hardcore images) unless the user has passed through the Birth Date Verifier? online age verification form; or, through some other type of SITE-approved online age verification device that complies with the requirements of the Child Online Protection Act, (?COPA?); or (2) Alternatively, users must be restricted to accessing pages or content, or Material containing only soft core (i.e. no sexual activity or explicit display of the genitals) materials, which content will be separately identified and provided by the SITE. Violation of this age verification requirement will be considered a material breach, and grounds for automatic termination of this Agreement.


Which I take to mean that if you push nastydollars using TGP or freesite traffic that's not to a softcore gallery OR even use many of the banners they provide it can in theory be grounds for terming your account. Now I'm presuming they don't as a rule do so or there'd be a lot of pissed of people but seems a dodgy rule to have in any TOS.

No beef with nastydollars. As I say just strikes me as a very strange rule all things considered.

But they are just rumours at the moment. They need to be clarified as rules like this being enforced for whatever reason would obviously have a HUGE impact. If (or rather when seems more liekly) the new 2257 stuff kicks in things will have to change. However, this is going several steps further.

Thing is it then becomes worrying in case they decide to enforce it. After all it's in the TOS so they are perfectly entitled to. Doesn't affect me much as I'm not pushung ND at the moment but I'd imagine anyone who is would rather not find a huge amount of their galleries and/or sites suddenly put them in breach of the terms.

Why is it being stupid? The rule exists. Surely the fact that it exists is then 'stupid' and not asking about it.

It doesn't even 'cover their own backs' for anything, as a rule that is never enforced although it easily could be and despite knowledge of countless people breaking it, protects them from nothing. For it to mean anything in any kind of legal situation they would have to be seen to be enforcing it.

Again - I'm just curious why it's there at all and when/if it will ever be enforced. And again - if it's never going to be enforced what on earth is the reason for it exisiting?

Wouldn't it be better to post the answer for all who push you to see? Just a suggestion.

The question(s) is pretty simple. Why the rule, are you ever going to enforce it and if you don't ever enforce it what's the point as it certainly doesn't 'cover your back' in that scenario as many suggest.

Genuinely not trying to be awkward just badly want to know for two reasons. Firstly if I start sending traffic and secondly in case others start copying in their TOS.

The worlds a small place these days and not all subject to US laws so it's not that simple.

Has little to do though with the questions asked as at the moment people DO use hardcore material outside of protected areas. I'd even say that the huge majority of ND's and other sponsors affilate traffic comes from hardcore pages not following the guidlines.
