The second term is always for presidential pet projects. Whatever he wants to do, he will, without regard for constitutionality or how it'll affect votes. It's ominous to think that the last several years has actually been the Bush admin acting with restraint.

A President can initiate Executive Orders within limits...and the Executive orders can only stand if the Supreme Court decides that the order is within the power of the office of the Presidency and are also within the frame work of the Constitution...so no...President Bush will not do anything "without regard for the constitution".

Bull fucking shit! Tell that to the guys at gitmo that lost two and half years of their life! Then think about the secret courts and *detention centers* in the US and the Patriot Act. It often times takes years in court before something gets around to the supreme court. In the meantime we could be fucked!

actually he used the recess in congress to circumvent that approval process. he has already installed a new a FTC chairman, and apperently can do so with judges too. the only catch for bush is that the appointments only last one year. but then again he just wait till the next recess of congress.

The Court has ruled that the guys being held at "gitmo" is within the law (though it is my understanding they did recently rule that they are entitled to an attorney). What "secret courts" and "dentenion centers" are you speaking of. I personally do not know of any...and apparently if you know about them they are not a secret...are they? Please educate me and tell me where these "secret courts" are being held and where the secret "dentention centers" are. The Patriot Act was made law by Congress by an overwhelming majority vote and not made law by the President. You are correct about laws being challenged and ajudicated by the courts...it is very time consuming.

If Scalia made it, then no, the democrats didn't defend us well.

A Supreme Court Justice's job is to be the last line of defense for american freedom. They are not 'elected' specifically because their job is not to please the majority. Their job is to protect the rights of minorities. To protect unpopular speech. To limit the power of the president to pass laws that restrict liberty. Their job is to defend the constitution.

Not to stamp 'approved' on whatever crazy religious agenda the president wants to push on us. Not to ally themselves with the president, rather to - by nature - oppose him. Their job is not to decide if something is morally right or wrong. Simply to decide if a law restricts freedoms that should be protected.

Scalia was approved by a previous Congress...not the sitting Congress. The Supreme Court has but one job and that is to determine what law does or does not fall within the frame work of the Constitution. Scalia is...as are all Supreme Court Justices entitled to their view of what law does or does not fall within the frame work of the Constitution within his apparent conservativism. If the Court was composed of Justices that did not have different interpretations of the Constitution the Court would be a "rubber stamp" approval or disapproval...body. In addition...every President...pushes their own agenda...nothing new about this...and your statement of "crazy religious agenda"...is your opinion.

Right now Bush has a declaration of War!!!

He does not have to give up the position during that dec. He has the ability as the commander and chief of the armed forces to stay in office until the congress removes the dec.

That was done so that we did not have to attempt to change a pres in the middle of an armed conflict. If he decides, he will use it.

Or he will pull that ever missing bunny ( Bin Laden ) out of his hat to win the vote!

Only Congress can declare war and Congress has not declared war...and even if Congress had declared war...I for one do not know what your are talking about.
