How will 2257 affect me?
Will I be safe if the sponsors I am using provide me with the required links?

You are Canadian? Nobody knows how this affects foreign webmasters yet, as far as I know. A few good threads to check out are Mutt's, Dready's, and mine about 2257. There are some interesting plans and questions brought up in them.

Aaron, why being so difficult? These are the original questions.

from what I am understanding, this is the jist of it

when it goes into affect if you have any images on a server YOU run or you control, you HAVE to have the 2257 for the model...so if you run a tgp and thousands of pics of naked people, you must have 2257 for each naked person that is hosted on your site

this is for the US though, as was stated before, no clue about canada and if they will be complying with the US laws

what if you have a banner that has a naked chic in it? Do you need 2257 info on that chic?

The law is built on precedent, unless they go into all the "what ifs" and what not, theres no way we'll know exactly what to do. Unless all the sponsors add a new section to their affiliates area called "2257 forms" for all of us to download, how do they suppose we get all of this?

I need a lawyer.

Now before these new changes affiliate meant you got to say you were in the porno business with none of the responsibility. This must be a terrible culture shock to them. If the picture is sexually explicit then you need a 2257 for banners.

Basically what the law says is that if you publish porn you need to be in posession of the 2257 documentation, Which is a legal ID, Passport, Drivers License, National ID, somethoing with the name, Date of Birth and the models picture.

You need to also cross reference every where that model appears on the Net, not sure if they want you to list where you have her or where anyone has her, and all her nicknames and modeling names.

Seriously go see a lawyer if you are in the US. Not sure how it will effect foreigners.

Eliminating.

If they were meant to improve then they would have gotten feedback from those within the industry prior to drawing up any proposed regulations. By reading the new regs it would appear that they have no fucking clue what it takes to become fully compliant or they are aware and banking on the chance that most people will not be able to conform to the new rules.

On the flip side....I am all for some changes to these old laws. I see nothing wrong with bringing them up to date and perhaps even making them more strict.....But let's be reasonable here.

I suggest anyone operating outside the US and promoting US Sponsors have their stuff together, if, for no other reason, to cover your ass. Regardless what the outcome of this new amendment happens to be, I see Sponsors becoming a lot more strict on this requirement with their affiliates. Why? Because when all is said and done, it is the Sponsor who will face the tougher penalty as the primary producer. And, if the affiliate is outside the US, you better believe they'll be even more motivated to go after and stick it to the US based Sponsor.

Bottomline for all (US based or not): Get an attorney, get compliant and stay that way.
