Epoch/Paycom new contract
Anyone else use Paycom.net as their third party processor? I just received a new contract from them and the wording of it makes me VERY leary!
They must have had their lawyers working triple-time on this thing. Among other things, it states that (bear with me here): "Releaser (that's me) irrevocbaly and unconditionally releases, acquits, cancels, forgives and forever discharges Paycom and its subsidiaries, affiliates, (etc., etc.) from any and all claims, demands, demands, liabilites, obligations, rights (blah blah blah)" The gist of it (as my un-legal mind understands it) is that I forever and unconditionally forgive them for any previous actions, and that I promise not to sue them. Obviously, I'm going to have my lawyer look at this thing, but I'm not sure I have any options other than to sign if I want to continue doing business with them. They charge an arm and a leg (as does their competition), but they are good at what they do. Plus, I'm wary of switching to an unknown entity. Anyone got any info on this? Also, when's the last time anyone got a reserve account check from them? |
