I'm currently giving content to some defendants, FREE, and have given cash already and will give more.

I'm sat in the Czech Republic and do not have to give a penny, in fact a win by Acacia would have been financially beneficial for us. We could have rolled back to here and operated from here. We could have opened paysites and delivered videos without having to worry about them. There patent is not valid here.

But I chose to fight, to give a time effort and money to keep this in front of people. I was assisted by a few notably Brandon . There are things that are right and need to be fought for.

This fight is not over, we just won a round. We need to make sure as an industry we do not falter and let it slip. As someone has pointed out this would be very sad if we were to lose this because of the lack of money.

There are many ways everyone can help. Make sure you are not funding Acacia by dealing with a licensee, dealing with the defendants instead. Sending money to those who have spent so much on our behalf already.

Look into yourself and ask ?WHAT CAN I GIVE?

In a 40 page ruling handed down today by Judge Ware it spelled out the various items and pieces of the patent claims that were in question and identified what the plaintiff (Acacia) believed was the correct way to interpret and what the defendant (New Destiny) believed was the correct interpretation.

Rest of the Story Here
pretty good analysis, I am impressed

I should go read these actual patents... This is definately some good news... but after reading thru some of the document, I'm stuck by the absurdity of it all... Having designed hardware devices in the past, from what I read about the defination of things etc., it appears to me that the original patents were supposed to apply to "hardware" devices and not "software". i.e. the actual hardware/electronics that compress/decompress data as it's sent via say satelites etc... Does anyone know anything more about the specifics of these patents? Or where I can go to read them...

This is very bad for Acacia... buh-bye...

I will be travelling on biz all day tomorrow, so I wanted to just get it out there for people to read before i can get a chance to digest it and present it in my own patented way. I'll write up my summary on the plane and post as soon as i can.

The short summary: it's all good for the defendants.

That's right. It's not over yet.

Any news that contributes to the overrall distruction of Acacia is good news and reason to celebrate. Being confident and keeping a postive attitude is healthy.

Thanks Spike, Clayman, and the rest of the leaders that are fighting to make things right.

I have to say, though, that those who sold out, (I hope), thought they were making a wise business decision at the time. However....

It's good to see that Acacia got bitchslapped. It's about damn time. Thanks to all of those who are fighting this, (and I walked up to Brandon personally in San Diego and thanked him. I wasn't thanking him just for my benefit or for the company I happen to work with, because neither of us would be bothered by the ruling, but for EVERYONE. That's comething about us as a whole: we're a community, more or less, and what hurts one can sometimes hurt us all.)

Just wanted to say again, congrats to the Defense group, and all the people that have supported them. It's not over yet, but this is a very good sign.

I'd also like to say, I hope all those that settled ended up paying the fees for a few extra years and end up in court over it. Would be ironic to say the least..

For all you fuck tards that haven't donated a dime

pimpdog go be a e-thug in another topic, this on is not for you. your e-thugged ass caved in and settled instead of fighting. So where your dogs at now?

Good post.

There is still a way to go yet and the bills still have to be paid.

Well if the judge only says the patent does not apply to those in the defense group that means those who are paying still have to ppay. Acacia might be meeting today to review the situation. Go back to courth and get a ruling that says the patent is not valid at all and lose everything.

Walk away from the fight and keep what they have.

There are many who talk and a few who put up.

Puppy has shown himself to be a fool on many occasions, now he's shown himself to be a liar as well. Not a good partner. I'm sure Acacia will not miss his money when they pull down the shutters.

Acacia's stock (actg) is taking a plunge today, down over 40% in the first hour of trading. Time to watch the snakes start to squirm.

I hope at the very least everyone switches their traffic/business from someone who caved in, to someone who is still fighting Acacia. This is one of the few times when it needn't cost a penny to support someone who isn't just thinking about their own short-term interests.

For $300 a month, your telling us that Acacia gave you an easy out on your contract?

All the contracts with them I saw were pretty explicit that the licensees were obligated to pay until a Court of final jurisdiction ruled the patents invalid with no further issues that could be appealed.

You might as well settle in for years of payments. The lawyers just spent months and months arguing over the meaning of the word "with" (among others), Acacia will appeal this forever, if only to keep the recurring income flowing from the signed licensees. Failure to pay by the licensees will be followed by a swift breach of contract suit by Acacia. Good luck winning that one.

Fight the fight!!!!

Well, for those of you who stood up and stood your ground, much respect.

If you'd like to hear the first interview Acacia did, you can listen to our archive when I had Robert on my show.

http://www.d-moneyshow.com/archives_...ly29_2003.html

I was sent papers from them and did the interview using the same streaming technology in question.

Chuuuch!

I personally like this line:

In this case, the Court cannot define the term "identification encoding means" because there is no corresponding structure in the specification that is linked to the functions recited in the claims. If the Court adopts this finding as its final conclusion on this matter, this would render claims 1, 3, 4, 5, 9, 10 and 11 of the '992 patent indefinite.

If every webmaster here on GFY donated $100, that would be enough to finally pound the Last nail in their coffin for good.

I saw the list Charly posted regarding the "Cave In's vs. "Our Defenders" ..... If you can't fine a few bucks to donate, AT LEAST SUPPORT and push traffic/sales to the Sponsors that went to bat for the Adult Industry. Every single sale you make help their bottom line which inturn will help the Good Fight! I just dropped one sponsor that was a "Cave In" and replaced it with a Supporter with the same type of site and niche. Here is the list posted by Charly

Admitting to abusing copyrights in a public forum?

Sleep on the settlement that you will be paying out when someone sues you.

Blacklisting and picketing companies that signed is not the way to go.. too negative..... show your support by joining the programs that are in the fight and do something positive.

A very strong precedent needs to be set to send a warning to any would-be patent holder looking to come trolling.

Money in the pockets of defense group members means more money to keep hammering... and hammers and nails do cost money.

Real shame this is thread is being ruined by the Markham-Pimpdog fight.
Although I'm no pimpdog fan and I really love Paul I really don't see why there should be so much anger.

So he settled? His disission!
Did he ever told you how to run your biz?

We all know about it now and webmasters that are bothered by the fact that epiccash is a buyout would have pulled all traffic by now. Since epic still stands (although many people were saying for months that they will be gone within weeks), they must be doing something right.

on a sidenote: Hasn't topbucks settled also?

why do they need more money exactly? these companies all make millions of dollars as it is?

How could they RUN out of money?

Why are you asking low end webmasters to chip in anything when these companies have MILLIONS to use to defend this?

I dont get it...

Unfortunately, I think you're wrong about being safe because you're located in Europe. The European Patent Office has granted Acacia's patent here as well. The number of the European patent is EP0566662. See http://www.ffii.se/acacia/index_eng.html for more details.

FFII, Foundation for a Free Information Infrastructure, is the leading European organization fighting software patents. The issue of software patents is currently under intense discussion among legislators in Brussels. Right now the outcome pretty much hangs in the balance, so it's possible that we'll be successful in out fight to ban software patent altogether here in Europe. That would make Acacia's patent worthless here.

But it could go the other way as well, so any constructive help with the political lobbying would be much appreciated. The issue will (probably) be decided in the European Parliament this autumn, so it is right now that the window of opportunity is open.
