18 U.S.C. '2257 question for party content (pics)
Since I`m on party every weekend I got an idea to shoot party content.
Do I need according to US laws (18 U.S.C. '2257) model release of people kissing or touching tits or genitals vithout nudity? Examples:    Can be this phase from US law "contains one or more visual depictions made after November 1, 1990 of actual sexually explicit conduct" applied to those images? For these photos I need model release for sure...   |

As I understand it, if the pictures are taken in a private place and there is not a clear notice stating that people will be taking pictures for publication then you need a model release, it's a privacy thing.
Then again if one of those attending the party happened to be 17 and 11 months, 3 weeks you could be in a lot more trouble. An 18 year old could tell his younger brother to come to the party. Always best to lean to the safe side, get the doc u ment ation right. And of course ASK A LAWYER. |
