Exactly, unless you specifically say he can not do this in your TERMS he wil own you what ever amount it is. A lwayer would take this on for a cut of the settlement.

His lawyer will argue that he was showing how honest you are as a paysite, how easy it is to reverse or terminate the sign up. That you are not one of these disreputable sites that entice people in and make it impossible to cancel.

He will also argue that you have such a great site that no right thinking surfer could possibly see it all in 3 days and would happily stay the whole month.

Now what would your lawyers argument be?

You would end up paying 2 lawyers, the affilates cut and a penalty for the court to decide.

BTW - I remember surfer was asking me why donot I have sign-out info on my site. He was afraid he won't be able to signout. After I explained him how this stuff works, he signed in. Now I have the signout info on all my signup pages...

Epic would have to prove he intended the sign up to cancel instead of pointing out how easy it was.

With Epic using "Free Porn" to sell their site they are going to have to point out that making the cancellation process easy and visible is part of their strategy. Unless they intend to get the surfer to sign up and hide the cancellation process.

Epic do not elect to approve webmasters pages, therefore they have to specifically say what is allowed and what is not. If Epic use "FREE PORN" as a gimmick, then they cannot blame a webmaster for doing the same. Troy is gambling on what a judge would decide or hoping it does not get that far.

For the couple of hundred dollars it would cost to pay out and cancel or educate the webmaster, he put his company at risk. Now tell me that was a wise move.

I also paid out on all of them, even the cheaters and will continue to pay out on on all the sign ups prior to my cancelling the program.

So I'm well aware of the problem and know it is only a few who are bad apples. I also plan to open paysites soon and am very reluctant to allow strangers to send me traffic in the hope of converting it. But if I do I hope I can be a bit more business like than some.

And once you open your affiliate program for your paysites, will you subsequently shut it down as soon as someone cheats you?
