On this speeding ticket there is a very good chance i might be! However, i would perfer to fight it myself and build my own defense since those xcopper guys are kind of iffy.
I've found a few ok sites but im sure lot of people here probably have experience in this field. |

He's hardly sol.. just fight it, it's not impossible the cop wont show.. and it's very possible the judge will at least reduce the fine.
if you were even remotly near another moving car, blame it on the other car.. if at ANY point the cop lost site of your car, it wasnt you. They cant do shit if they lose site of your car. Hell just last month, my x was speeding, cop pegged her going around a large corner at 3am with no other cars on the road anywhere. He had to turn around, lost site of her car, came flying up behind her a minute later, pulled her over, I told her to say she came down a road we just passed. he knew it it was bullshit, and he knew that we knew that he knew it was bullshit but he couldnt do fuckall.. other then say "I know it was your car, just slow it down".. Would have been a MASSIVE fine too, she was hauling ass.

im pretty sure this is the way it is in canada.. i dont know about in the states...
the cop car could have been marked, u just didnt see it.. what they do now is put white lettering on white cars and black lettering on black cars which is hard to see from far but you can see it up close... this is the reason why they do that.. just think about it.. if it was legal to pull you over in an undercover car, they wouldnt put black on black lettering etc. you check into it ;) its not my ticket |

Half of the time, the traffic cop dosent even show up and you win because the state failed to produce it's witness. The court should dismiss the case on its own motion if this happens, but if they dont you need to make the motion yourself. Thats as simple as saying "Your honor, Defense moves for dismissal pursuant to (cite the section of your state's rules of civil procedure that require the cop to appear)". ALWAYS fight a ticket, no matter what. Traffic tickets are all about money. Thats the only motive. They dont give a shit about saftey. If they did, they would correct all of those crazy 5 way intersections and straighten those goofy intersections on a curve and make them a 3 way. If you just pay the ticket, not only will your insurance go up because you plead guilty when you paid it, but you have just given a monetary gift to the government. The most expensive part of a ticket is NOT the fine or the court costs. Its the increase on your insurance rates. It is almost always cheaper in the long run to fight a ticket than to just pay it. In fact, I have had several judges Court costs are a fixed amount in EVERY state set by law. In Indiana, they are $89.75 (if I remember correctly). Paying my ticket (the same one I wasted thier time for 4.5 hours over) would have cost me $130.00. The judge fined me $5 plus costs after I pitched him a sad song about just losing my job (they usually will reduce the fine for this - so be sure to take your kids to court with you if you have any) so I still paid less than if I would have just got out the checkbook. At least if you take the ticket to court, the amount of cash from the fine that gets to the government is reduced because they have to pay the court reporter, the cop, the judge, the prosecutor and so on. If you get a ticket, take it to court and the cop does show and you know FOR A FACT that you cant win, simply do your best to drag the trial out as long as you can. I suceeded in wasting four and a half hours of the court's time on a red light ticket case because the cop had me on camera running the light from his patrol car. I couldnt win, but I was determined to have fun wasting thier time while I was at it. I have never seen a good website on this topic that dosent charge, but there are two very good books you should get. The first one is called Beat the Cops by Alex Carroll (ISBN 0-9634641-1-6, $9.95 US) http://www.amazon.com/exec/obidos/ASIN/0963464116/ The other one is Beat Your Ticket: Go to Court and Win by Atty. It is usually in stock at all Barnes & Noble stores.

Be sure to find out what make, model and year of car the cop was driving and wether or not it was outfitted with a Genesis radar gun. They are defective and will clock a rock at 70 MPH, according to the report below in the Philadelphia Daily News.

Also, if the cop claims that he clocked your speed at "X" miles per hour using radar, you should know that radar is (or can be) inaccurate under the following circumstances:
1. If the cop has a CB radio in his car (or if you were stopped on an interstate and there was a trucker near you, his CB radio could have done it) a high-pitched whistle can distort the radar reading. The reading depends on, and increases with, the pitch of the whistle. 2. Radar reads the speed of larger objects before smaller ones. So if a truck is passing you, the speed being displayed is that of the truck regardless of if the cop has it aimed at you. This is espically true the further away from you the cop is when he gets the reading. The radar beam spreads out over distance, unlike a laser beam - which narrow and straight. It is called beam divergence. If a cop is 1/8th of a mile away from you, he is really clocking four lanes worth of traffic! 3. Belive it or not, blowing dust or debris and even RAIN or SNOW can cause an inaccurate reading, because the radar will read the speed of the moving crap/rain/snow instead of you. If you are going to use this as a defense, take a copy of a weather report into court (two is better, one from the National Weather Service and one from a local paper - yes, take the actual paper in) to prove that it was windy. 4. High tension powerlines, transforms, neon lights and lightening create an electromagnetic field and/or harmonic distortion that may cause a bad reading. These are the powerlines that sit on towers. If you were near these, have a picture ready to prove it. Ask the officer if thats where he stopped you - he'll answer you honestly because he wont see the powerline issue coming. 5. The cop car's air conditioner or heater can distort the reading. The radar unit can read the fan speed of the heater/air unit instead of you. If it was summer when the ticket was issued, be sure to ask him if he had the air or heat on. He wont see this one coming and he'll likely answer you honestly. The prosecutor will probly even object on the grounds of irrelevence. And the judge will overrule the objection if you promise to show relavence because curiousity will kill the cat. Another reason to get a weather report. 6.

Fighting speeding tickets is pointless, because generally, you were speeding. Just dont speed next time. I never go more than 10km over the limit and I've got a squeaky clean record.

funny that this was brought up tonight...today I won in traffic court and got my case dismissed
got speeding ticket back in Sept.2003 and kept getting extensions...went to see judge to schedule a court date...date was set for today....then took my chances of cop not showing up and it worked saved me 300 bucks and increase in my insurance premium this has worked for me before...so now i am 2 for 2 |
