I find this odd too.

They said this to me "After reviewing your site, and in accordance with Section 11 of the User Agreement, your account has been closed. Your funds will be held for 180 days from your last account transaction. After 180 days, we will release your funds by either mailing a check to the address linked to the account or by bank transfer"

Section 11? Have you guys read section 11?

Here is what section 11 says:

Remedies and PayPal's Right to Collect From You. Without limiting other remedies, we may update inaccurate or incorrect information you provide to us, contact you by means other than electronically, immediately warn our community of your actions, place a hold on funds in your account, limit funding sources and payments, limit access to an account and any or all of the account's functions (including but not limited to the ability to send money or making withdrawals from an the account), limit withdrawals, indefinitely suspend or close your account and refuse to provide our Services to you if: (a) you breach this Agreement or the documents it incorporates by reference; (b) we are unable to verify or authenticate any information you provide to us; (c) we believe that your account or activities pose a significant credit or fraud risk to us; (d) we believe that your actions may cause financial loss or legal liability for you, our users or us; or (e) your use of your PayPal account is deemed by PayPal, Visa, MasterCard, American Express or Discover to constitute abuse of the credit card system or a violation of credit card rules, including (without limitation), using the PayPal system to test credit card behaviors. Even if they have been recorded as completed in the Recent Activity or History Transaction Log of your PayPal account, transactions are not considered completed until the funds have been charged to the customer's funding source (for payments) or posted to the customer's bank account (for withdrawals). In addition, PayPal reserves the right to hold funds beyond the normal distribution periods for transactions it deems suspicious or for accounts conducting high transaction volumes to ensure integrity of the funds. If we close your account, we will provide you notice and pay you all of the unrestricted funds held in your PayPal account. Additionally, to secure your performance of this Agreement, you grant to PayPal a lien on and security interest in your account. In addition, you acknowledge that PayPal may setoff against any accounts you own for any obligation you owe PayPal at any time and for any reason allowed by law. These obligations include both secured and unsecured debts and debts you owe individually or together with someone else. PayPal may consider this Agreement as your consent to PayPal's asserting its security interest or exercising its right of setoff should any law require your consent. The rights described in this section are in addition to and apart from any other rights.

Now thats bullshit cause the above talks about fraud. So what on earth does that have to do with me and why have they changed their statement. They claimed that it was because I made reference to paypal.com on my website (which I never did), and now this.

This is true. I'm not saying I agree with the freezing of funds, but they are pretty much covering their bases with the TOS issue. I doubt the people who started the class action lawsuit showed the lawyers the evidence that would hurt their case.

Same thing goes for your website. Lets say you charge $19.95 a month then decide to change it to $29.95 a month. If there are members that were paying $19.95 and are still getting rebilled, the price will remain the same until they decide to cancel. Should they choose to sign up again, they will now have to pay the $29.95 because they are agreeing to your new terms.
Your reasoning will always amaze me; entertaining but extremely sad that you brought new life into this world.

Since you don?t like any of my suggestions do a search on Pr0 and read what another member said about using an adult email with paypal.

Still want to know how your boobie quest is going.

Please understand that its not my reasoning. Its called a grandfather clause.

grandfather clause definition ? a grandfather clause is a provision of law that exempts certain persons or pre-existing conditions from the scope of a regulation or requirement

Im calling epassport to ask some questions and to see how their tech support is, but I have been on hold for 15 min. Time to hang up.

They say 24/7 tech support but so far its more like 24/7 hold time.

Anyone else have any suggestions as far as paypal alternatives?

Besides yahoo paydirect?

Okay so I am the idiot. Paypal sends out an email changing their TOS, in order to log-in to ones account after the deadline to agree; one has to check mark that they agree to their new TOS. Basically, that is signing on the dotted line.

As far as grandfather clause, why did thousand of webmasters stop accepting paypal for services render or donations from an adult email addy when they could of just said they were exempt because of the grandfather clause?

I am feeling really dumb, and I still would like to know how your boobie quest is going.

I'm guessing that this is the money that has been frozen and she's trying to get access to. Someone here blew her in for sure.

Yep you got it. I cant access that money so I cannot put it towards the surgery.

RIght now it is frozen.

Surefire, dont feel dumb. This isnt a question of intelligence. It's all about how paypal is handling their issues.

Regardless of a clause or not, they are claiming that I referenced the paypal name on my site and I didnt. I mearly have an email
address that is on an adult domain. The two are kept seperate.

They are just full of crap.

Eeven if I was it wouldnt matter. There is something called a grandfather claus. When I signed up with paypal, they allowed adult transactions. When they decided to stop, they sent out a mass email. They never had us sign a new "terms of service" agreement. Which means I can still legally accept adult sales.

Whe I was on the phone with the FTC, they told me to file a suit because they are in breech of contract. I do fall under the grandfather claus, and so do most of you.
Uh, do you ever read the terms of service? They HAVE the right to CHANGE the TOS at any time! You don't have to sign the new one! So you are fucked! Fucked AND STUPID!

I still use paypal, have had no problems with them, because I don't use it with adult transactions, like your not suppose to, and I don't use a adult email either!

name calling isnt necessary.

Yes I read the TOS, and they can write whatever they like. If everything was legal they wouldnt have had so many lawsuits against them, including this one.

I just got off the phone with PayPal..AGAIN, but this time I found someone helpful. She went over my account and even checked my website. She found nothing to be breaking their rules and is releasing the money in my account.

She said I should have it in my bank account by Tuesday

Let's see if that really happens...
