business license

How many of your have a business license? I mean people who run their own sites. Not big companies. Like naughtyjenn, kayla cam, etc.

Do you have a business license?

until today I was unaware that you have to have a business license to operate your own website.

Ok I think its fuckin retarted but you have to have one. Being that I am making a profit off of my website, the law considers it to be a business and they told me I need to get a business license or shut the site down. Nedless to say I am going tomorrow morning to get one.

So....how many of you have a business license in order to keep your website legit?

Business license? Why would you need a biz license to operate a website? Maybe they're talking tax id's and stuff of that nature if you're selling product on the site as well in addition access.

Heather

Are you referring to a structured thing like a corp or LLc and a Tax ID number such as 03-0495555?

Nope they said that because I am making a profit that its a business. Its a god damn nightmare. Its like they just wanna pick on the little guy. I mean for god sake. I am one girl, putting totally legal pictures of myself on a website and making a few bucks off of it.
Its totally rediculous but this is what the laws are.

Reason is most city laws require you to have one if your operating any business from your home. Ussually if your not within city limits and in county limits your not required to have one.

Will you get into trouble for not having one? Prolly not. For example here where I am at if they find out your running a business without one they just tell you to get one and add a fine to getting one.

Reasons I have one. One less door for the law to fuck me on as they look for reasons to bust your ass. Two I am not ashamed of what I do and have no reason to hide.

That's really gay and it does sound like a local law of some sort, as do a lot of local municipalities have them about operating out of your home. You might as well grab a tax ID while you're at it and setup your self biz stuff so that you're making estimated tax payments throughout the year to cover that ground too. Otherwise if you can hide it real well just say fuck'em, when they catch you all they do is ask you to pay the first couple of times, if you don't setup a payment plan then, they'll start taking your shit.

Its only like $35 and it will cover your ass. I cant understand why the targeted me though. I am obeying the local laws and I even have the warning and 2257.

Damn commies. Always trying to keep the underdog down!

They are real cheap just make sure you lowball everything and list only 1 person working ect. Read the rules and back carefully often you can get them for free if you qualify.

On a brighter note, they are tax deductable.

BTW no it is not a tax id number nor a resale permit. Do becareful as they can use it to nail your ass on zoning violations though.

It is a business. You are charging people for access. Why do they even know you run a site to begin with?

Yeah I may as well do that as well. Oh maybe I should point out that I am in the FUCKIN common wealth. You cant do shit here without them fucking with you.

I was unaware that a business license was needed but they found it necessary to make it VERY clear.

Im gonna go get one but I have a feeling it wont stop at that. Virginia is a difficult place to life and as soon as this shit is all overwith I will be moving back to ft. lauderdale.

Fuck if I know. They found my website somehow. I asked them that. They said they came across it.

You dont just come across it unless your looking for it. They wrote me up for it and I have to go to court on March 25th for it.

Im sure it will be deropped but thats not the point. Now I have to worry about my attorny getting involved, court costs, missing work, and getting a babysitter.

This is fuckin bullshit. I should probably mention that VA is one of the great places to find dirty cops. Even when you do nothing wrong, they find a way to get you.

Juicy, come on... She runs a business that charges people to get access to a site. Of course they want her to have a biz license because you are supposed to collect sales tax on visitors from your state. Some cities may not require it but most do.

A ficticious name allows you to open a bank account under a name that is not yours. jDoG web services for example if your name was John Smith. Now if you do business as John Smith web services and your name was John Smith odds are you would not need a ficticious name.

BTW getting a ficticious name is often how they find you for the license.

Do not confuse a business license with a resale permit number or tax id number. A business license has nothing to do with collecting tax on stuff you sell. It is a yearly fee to do business in the city you live in.

Then yes you will need a ficticious name. Then you will take 1 copy to your bank, keep 1 for your records, and use the last one to run a notice in a local newspaper for so many weeks (ussually 3).

Yea, that's how it is in some places in OC. Some places you can't even have yard sales! It's bullshit!

Umm, I wouldn't think that you would need a business lisence unless you are actualy conducting business at your home. IE: having your surfers come over and hand you cash to join your site.

All the billing and shit takes place in a different state (from your 3rd party billing agency) they are the ones who are dealing with the customers.

I would tell them to lick my nuts

you dont need a business license unless you are selling something tangible that you can put your hands on. A paysite does not require a business icense unless u are selling merchandise.. trust me on this. Unless you are or your state laws are different. You do however need a tax ID number which I'd suggest getting. Also it is better to incorporate (I'd suggest thru Delaware or Nevada if you don't mind paying extra because it gives you better liabilty protection. If you do that you have to file a doing business in another state paper though. You wont save money on taxes but you can never lose any of your assests. Make them give you a free record book and company seal (you will need it when you open your business account).

If you are advertising in any name other then your companys or have a name other then that on your website then you have to file a fictitius name so they can know its you.

You want to get your license for internet marketing. They wont give you a business license for a adult site and it will bring up tons of zoning questions.

oh I forgot to write, we are a single site and we have business license , a accountant and we are a llc. This was one of the reasons for the first year we both worked and didnt touch the money the site made so we could pay for all these things to get started.

I think you might be talking about a trade name, If you dont already have a business name you need to file for a trade name, it is about $25 and it takes about a week or two.

If you already have a trade business name but for some reason want to use a different name then you file for a fictitious name

I don't know why you're even asking this question Heather. Not having your business license is like bending over, and ASKING the system to fuck you in the ass. Before I started my business, I was told by the Clerk's Office that I needed to have a business license in every county I did business in. Ok, I know that's a load of shit that they're pulling, but I now have two business licenses... one in Placer County where I live, and one in Sacramento County where my studio is located. This is all in the name of avoiding getting FUCKED by the system.

Depending on where you live, some places do not require you to have a business license. In Florida it's different from county to county.

The city is going to try to fuck you. Now they are going to wonder why you are not submitting tax to the city... Get an accountant is my advice.
