:stop Acacia sues Club Jenna

Court documents were filed on 12/18 against Club Jenna Inc. by Acacia.



Additional lawsuits filed against:

Orgasm.com
Webpower Inc.
Cybernet Ventures
Global AVS
ICS Inc.
National A-1 Advert



In addition, Acacia is proposing to the judge to allow for 2 class action lawsuits that cover the entire adult industry.

At InterNext, on Jan 5th (monday) at 4pm, Spike, Gregory Clayman, and I will be discussing how patents affect businesses and what can businesses do.


This should really get interesting.

They definitely taking on the wrong people. National A-1 can and probably will get the best lawyers in the biz to fight this.

Nobody of those guys is going to fight them, they are going to settle for yearly contracts of a lower number so Acacia can put them on their DONE list.

Its cheaper to pay 10k per year for a license fee than pay 1 Mil. to fight a Patent

be interesting what some of these companies getting sued now do. Even though acacia says the introductory rates are gone, I think some of these big ones will still be given sweethearts as a last ditch effort to try and seem credible.

A company doesn't have to shoulder the financial burden of fighting alone.... there is a Defense Fund of the CURRENT 11 defendants to pool their money.

No company should think they have to fight alone...that is the part of the intimidation being put out to convince webmasters to settle.

The CURRENT defendants will start their court proceedings on Feb 6th.

I am sure these new defendants have already contacted Spike to learn how they can join their Defense Fund, and be able to defend their companies as well as all other webmasters, by banding together as a united front.

Well it depends if these guys join the fight or weazle out like Hustler did.

We either fight Acacia to the finish or you can bet Acacia will squeeze as much money as they can out of us. Then they walk away with a fat profit and the next firm of patent lawyers come knocking on our doors. Will those fighting today, want to fight again?

Remember Acacia are trying to make a profit not protect a patent, they do not stream video or audio nor offer any product connected with streaming. It's about making a profit and if we let them this will all happen again.

Support the licensees and you send money to Acacia,

Sooner or later they need to start making money and stop giving away sweetheart deals.

Hustler's licensing money wasn't part of the $186,000 collected in third quarter as some acacia cheerleaders have stated.

Given that Hustler's internet side makes about $1.3M/month and has non-internet revenue streams of Video on Demand, you would think it me a large spike in revenue for Acacia n 4Q.. but most likely it will be peanuts.

Also remember.....Acacia's DMT patent is not ONLY specific to internet downloads of audio and video.

It also applies to satellite and cable for Video on Demand.. so for all those video based companies that think they are clear of Acacia because they don;t do any internet-based streaming, you are mistaken.

One of the things acacia has achived is to convince many that you need $1mil or other crazy amounts to fight their patent. Reality is far away and every middle size company has the funds to protect their interests.

I don't see how they can lump the whole adult industry into these two classes...... there is two much deversity and size difference.

I talked to some mainstream companies, and buying into the Defense Fund for $35K was far more expensive than paying for the bag of peanuts as their licensing fee.

It is "cheaper to keep her"... that's what businesses who are in the startup phase, or making modest revenue are faced with.

I have talked to many that have signed because they had no other choice.

Hopefully with these new lawsuits, some additional big guns will now get involved and we can get this smackdown moving along.

Im far too busy right now, but someone must make a list of those who caved, or took sweetheart deals, and then have webmasters who agree not to promote them post their intentions not to promote any companies who cave ... companies need to know that if they cave, they are going down the shitter ... and webmasters, you need to care about this. I will help organize or host this list, or whatever i can do to help it, i just am buried and cant get the ball rolling on it. I think it would be a good idea however to not send your traffic to programs that are funding extorcia, and furthermore to pressure these high profile companies to take a stand.

I hate law suits... I just lost mine against the local chamber for not paying me... but my attorney was an IDIOT. He NEVER argued intelectual property, all he stressed was I did the work and did not get paid... so the judge (another hick, the fucking courtroom is in a strip mall) ruled he said/she said.

On the plus side, he also ruled we each pay our own legal bills... so at least I don't have to pay their legal bills too.

I have to appeal this... did the intelectual property laws change in the last year? I mean I created the artwork for the site.. it is mine right? especially if they never paid me.
