Why I love CCBill and hate IBill

I found a big time thief who had ripped one of my sites and used the pix to sell his pay site...

A quick email and fax to CCBill with the DMCA and the ball started rolling.. 24 hrs later the images and galleries are still on line and CCBill have now stopped members getting in.. New members signing up and even renewals have been stopped.. I love them..

I faxed and emailed IBill earlier today as they are the sites secondary processor.. Do you think I've heard back from them .. NOT A FUCKING HOPE IN HELL..

The thief also used my pix to sell an ARS site.. They took immediate action and terminated his affiliate account so..

INAL but unless I am mistaken the DMCA says nothing about a 24 hour period. It merely says a Service Provider must:

"upon obtaining such knowledge or awareness, acts expeditiously to remove, or disable access to, the material"

The thief wouldn't affect most of you as the site is www.indianpleasure.com .. He stole my work cos it's unique and exclusive.. I shoot it myself..

As for selling it.. I only sell it to one other wm and that's a minimum of 3 months after I've had them on line and cos he's a friend who helped me get started in this biz.. Sorry

Watch out as very soon there'll be a series of dvd's I shoot at the same time as my stills being released and the supplier is selling them on line... Plus.. You can sign up as an affiliate to the programme and sell them yourselves.. The series will be callled either UK Indian Girls or Anglo Indian Girls.. We're still making our minds up.. Also they will all be solo/toys films..No g/g/ or b/g yet... I'll keep you posted..

I cant say the same, I emailed, called and faxed DMCA to CCBill and they gave me such a run around it was ridiculous. I showed them clear proof of a site that was using stolen content I SHOT myself in their members section and they did nothing.

I waited a few days and the guy (@ CCBILL) told me THAT I emailed ccbill and told him that it was ok for the site to use the content. I asked him what email address this SUPPOSED email came from he gave me: [myname]@aol.com - It was the lamest excuse/reasoning I have EVERY heard.

I resolved it myself, no thanks to them.

Did you try contacting the hosting company? You should contact them, before contacting the billing company. What kinda proof have you shown both CCBill and iBill. It would be ashame if CCBill stopped the billing with no proof that you own the content. It would also be ashame if iBill still allowed the billing, if you showed proof of content ownership.

The DMCA mandates 72 hours (business hours as in three business days) for the host or provider to respond else be open to fine.

First of all I've been sending out DMCA's for a couple of years with 99% success rate. In 2001, I put this page up: www.indianpornlords.net/digitalact.html to help other wm's and it's helped quite a few.


The DMCA law states that the offending webmaster must remove any copyright infringing material within 24 hours of the notice being served. The notice is also served on the hosts, avs or cc processor at the same time and they have the rights to switch off access to the offending site if the wm does nothing within the 24 hours as in my case now.. CCBill have stopped all access. If the hosts do nothing then the DMCA is served on their upstream provider. I've only had to do this once as the host acted like an arsehole and that worked.

As for evidence .. Being the photographer I supplied raw images as samples from the shoots. Also as I only work from my place all the sets are near enough the same. The offending wm has to send proof he has legal rights to publish the material being complained about, like a licence..

This guy has his own server at Rackshack who I served the DMCA on and I've heard fuck all from them but CCBill did their part

The Dawg: I'm sorry you had a prob at CCBill but I know some of their guys personally from meeting them at Internext back in 2001 so they know that if I send a DMCA it's 100% kosher and a follow up phone call to them after I sent it confirmed everything..

Fabien: I know my designs are crap but they sell.. They're simple and easy to navigate, so the surfer gets to where he wants without any difficulty or any pop up's.. Some times simple is better.. Also I have content legally that not many others do. My pay sites are 100% Indian. Richards Realm has done a review Also it's neither ibill nor iwill it's more like wedon't

And still no advise on who to contact at IIBill.. ah well .. Does anyone have a contact name who I can scream at ?

Finally even though I'm subscribed to this thread I don't get an email when a reply is made so please spam me at webmaster @ ravishing indian dot com if you have an IBill contact..

If it is not in there, remember courts and court decisions change and append laws by their decisions. I've seen court cases citing no more than 72 hours after the law came out and they discussed "safe harbor" issues; so if it's not in the law as passed, it's been "invisibly" added to and determined by the courts as to what is considered to be "a reasonable amount of time".
