Promoting sponsors that settled w/Acacia
I know a lot of people on this board hate acacia and what it stands for, but I was just curious if anyone was so upset with the companies that didn't fight and just paid, that they were upset enough to just simply stop promoting the sponsors because of the principle. I mean I have not got involved either way, I was just wondering if anyone has felt that strong about fighting the patent that they just simply quit promoting a sponsor that paid Acacia?

This has been gone over before, that even if the sponsor signed a license, that doesn't mean that you are protected from Acacia when you promote them. This where Acacia is being accused of double dipping. They are going after affiliates of these companies, even though the video might be coming from the sponsors own server.

My sponsors are fighting. I don't agree with Ac@ci@'s business plan to generate revenue by suing people. So I am showing it by pushing sponsors that have the same opinions as myself. I group Ac@ci@ with the likes of people who spam search engines.
I would feel different if Ac@ci@ was trying to improve ways of transfering data over the internet, instead they are just claiming a patent on technology that was already out there is valid by buying over the firm that originally patented it. What new technology have they come up with??? Courts will decide in time whether or not the patent that was issued should be valid. It is in our best interest, as webmasters, to help the companies already in courts to get this matter settled, because Ac@ci@ probably won't be the only using this business model. If Ac@ci@ wins, then so be it, atleast we will have fought and can look at ourselves in the mirror everyday and know we did our part. |

This shoud clear things up: Berman said in a recent xbiz article: "In most cases, if the sponsor licenses from Acacia, the affiliate will be covered," Berman told XBiz. "In order to avoid liability for patent infringement, it is in the best interest of affiliates to send traffic to sponsors that have licenses with Acacia." http://xbiz.com/articles/index.php?article_idp=778 I believe that Hustler was the first to make it clear in their agreement, and since then, Acacia has become better educated about their (absurd) tactics, and i believe they now will not target affiliates that use licensed sponsors. Problem is that most affilaites have multiple sponsors, so commissions earned from a unlicense webmasters would go towards the Gross Revenue total for their licensing fees. Fight the Patent!
