ACACIA & IMPA hmmmmmm......

You know I just saw this quote and it sounded interesting, what do you think?

Quote:
So far, the remaining adult content providers have rallied around the The Internet Media Protective Association, set up by the adult online community to fight Acacia. Every site that licenses the DMT patents, however, must essentially pull out of IMPA; a licensee may join and assist IMPA or other efforts, but it risks paying an additional settlement if the suit is rebuffed in court, Berman said.
Only makes me wonder what the so called licensees are actually doing to support the IMPA and really why would you settle if you're going to try and support the fight against the patents? I really don't think these licensees are fighting the patents honestly, I think they essentially being big companies first in line signed sweetheart deals, turned over their affiliates and pay lower royalties. Playing both sides of the fence to save face but are they really contributing in a substanstial way to the IMPA with all the money that they saved by not litigating ACACIA?

Acacia may be able to make a corporation sign some deal to not give money to the IMPA, but there is no way they can stop all of the individuals in those companies from donating money if those people really want to.

If Larry Flynt wants to donate money to a political cause, they can't stop him.

The question is, do these people who are settling even care?

That's what I'm saying they don't care, I would like to know what the penalty is that they receive for supporting the IMPA if the case is rebuffed. As well in not litigating the patents they likely got lower fees and saved hundreds of thousands in legal fees, so for a big company to turn around and give $1000 to the IMPA is really just kissing some ass to save face.

Just like Far-L coming on here to support Matrix claiming that they aren't handing over their database or accounts and imply that it was taken by illegal means and handed over or something to that effect. Would that explain how someone can just now sign up and only days later receive a mailer? Is someone taking and reselling the info every day? It all sounds a little backroom mafia like to me.

I have heard that none of the people who claimed to settle and still support the fight monetarily are doing so.

They made big claims but to my knowledge none of them are doing jack shit.

I'd have more respect for a company that licensed and came out and said hey we did it because it was cheaper for us and fuck any of you that don't like it. If you want to make money with us do so and if not then fuck off. But instead they all lie and save face and kiss ass while they're handing your head over to the extortionists to save their legal fees. Then they throw out a $1000 check or something small to them and need a ton of publicity for it and shit and get the support of the people running the IMPA.

Things are not always as they seem people and something is fishy here.

Matrix is one of the few that we know for sure are supporting 'em.

I guess if you accept someones post on GFY as proof then that will suffice but I don't think most of us are that dumb.

Because Acacia can and has shut down those people that have been served that ignored the patents. And if they choose to fight their own fight in court, the court may or may not allow them use of the technology during the time that the court battle is going on.

If you go to court they are not going to file an injunction to prevent you from using the technology, the only people that were ever shut down were the people that didn't go to court. The reason they accept the license fees is because they figure it's cheaper and they will play both sides of the fence. These big companies that accept licenses right now are doing so for cheaper royalties and sweeter deals only strengthening ACACIA's case and they are doing it to sell everyone out. It's pretty simple really, it's all about money and if you trust anyone in this biz to tell you the truth then you'll always get fucked.

Uhh.. someone's post? Far-L, as in.. Home Grown Video, Home Grown Content. As in, one of the companies that founded the IMPA. I am pretty damn sure that what he has to say on Matrix slapping down some major cash has a fair bit of credibility.

Allow me to retort...

(Pulp Fiction... still a classic...)

Matrix did contribute a good chunk of change BEFORE they settled.

Regarding defending Matrix... at this point... I would be happy to eat those words. Does that mean I condemn Matrix for letting their list out under any circumstances? Not necessarily... everyone has to do what they have to do.

I am sure that others who settled may also have turned over their customer lists. Hell, I have heard some say that the way they were discovered was by being a Homegrown Cash affiliate... and Lord knows we were not about to give Acacia our affiliates and/or content clients.

It will all come out in the end... who is lying, who is telling the truth... who is protecting his peers and who is selling them out...

And when that finally happens... I will be able to do my best "Jules" impression...

"The path of the righteous man is beset on all sides by the inequities of the selfish and the tyranny of evil men. Blessed is he who, in the name of charity and good will, shepherds the weak through the valley of darkness, for he is truly his brother's keeper and the finder of lost children. And I will strike down upon thee with great vengeance and furious anger those who attempt to poison and destroy my brothers. And you will know my name is the Lord when I lay my vengeance upon you"

Thanks for the compliment!

The minute I get an attitude and come off slighted by someone else's opinion I want a smack upside the head.

BTW: So far, no one who has settled has helped the IMPA, which I am sure is much to Acacia's satisfaction.

That's kind of what I was getting at a little wasn't it. Since they have all just been playing both sides of the fence all along.
