Is it okay to gank someone's shit?

In a thread that has been locked, it was pointed out by Amp that his design and Adult.com's $10 concept had been ripped off.

Here's my question. At what point is it okay to copy an idea and brush it off as merely the cost of doing business?

There are two ideas here that when added together, IMO, become a unique concept. The first part is the design, which admittedly is not original and the second part is the low price, which is also not original. However, the combination of the two seems to be where the difference lies. If the design or the price had been copied in any different combination I doubt if Amp would have brought this up, but considering the similarities in the designs I think the addition of the under $10 pricing model makes this far more than a coincidence.

Here's another point. Some of you have stated that the fact that the sites were shown off at Internext, which was 6 weeks prior to the actual roll out has some sort of bearing on the issue. I don't see the logic in that argument.

Let me illustrate my last point with an analogy and then I'd like to hear some feedback on my thoughts. Suppose I answer a call from a large corporation looking for a design firm and they ask each firm to submit some design ideas from which they will select the finalist to design a completely new corporate identity as well as their annual report. Several firms submit designs and then several weeks later all of the firms receive an email thanking them for their submissions but that the company has decided to do the work in-house. Some time later one of the designers sees that company's new logo and annual report are remarkebly similar to the ones he submitted. Should it matter that the designs were seen prior to any of the firms actually being hired? Of course not, the designs were completed and the ideas were stolen. Period.

The bid entry most likely would have allowed for that situation.

On top of that, the design firm would have been stupid to submit "ideas". That's what portfolios are for. Don't leak your shit if you don't want people "copying" your ideas.

Let's be crystal clear on this ok.

It's one thing to come up with a similar idea / program as someone else, but it's totally another thing to say someones designs were copied.

I take that very seriously when it comes to our companies.

Our team was given a project to do and we did it. All original work, etc.

Businesses react to each other all the time.
One gas station lowers it's price and they all copy the same price for their "market".

Once a winning idea is launched - it always gets "copied". If the idea was so unique and so original it should have been patented.

$50 dollars per month for "porn" is just a rip off.
With so much free stuff out there a $10 model was a logical conclusion not an original idea.

I look forward to investigating Adult Platinums programs.

The government, non-profit corporations and many other large companies do this routinely when they call for bids on a project. The firms that really want the work submit several concepts (not necessarily completed designs) along with the bid proposal. This is done in good faith and the designs are copyrighted to the designer as soon as they are put down on paper. If that company then does not hire that designer but produces the work in-house and there are enough similarities, that designer has a legal case.

Judging from some of the comments made in the other thread it seems to me that there are too many non professionals doing adult design work that don't understand how business works. My point was, the fact that the designs were unveiled at Internext, which was 6 weeks prior to the actual roll out of the websites has no bearing on whether or not it was okay to copy the designs and the pricing model. Unless of course you are totally ignorant of the law and say that designs are public domain. That's real intelligent. I suppose he also believes that photographs on the internet are public domain too and he is free to use them on his website.

I'm not sure I was making an analogy there I was just making a sarcastic point about how silly it sounds to say designs are public domain.

Here's an analogy for you.

A guy at Ford designs a new car that looks almost identical to a Corvette. They both have wheels, doors, seats, engines and all the other things cars have but the 'look' of the cars is virtually identical. Are car designs public domain? Do you think anyone at Chevrolet would have anything to say?

I'm not saying anyone copied anything or passing judgement, although I find it hard to believe that the designs and the pricing model were both developed indepentently by two different companies at the same exact time.
