Microsoft Changing Explorer, May Affect Large Numbers of Web Page
Microsoft Set To Change Its Internet Browser
Microsoft Corp., which this month was found to have infringed a patented method for viewing Internet pages, will make changes to its Web browser software, according to the World Wide Web Consortium trade group. The consortium, which counts Microsoft as a member, said the company will make changes "very soon" to its Internet Explorer program that "may affect a large number of existing Web pages." The group made the claims in a statement on its Web site, citing conversations with unidentified Microsoft officials. Microsoft spokesman Jim Desler said the company "may take precautionary steps in response to the ruling." He declined to say what those steps are and confirmed Redmond, Wash.-based Microsoft has talked to the consortium about the ruling. Internet Explorer controls about 96 percent of the browser market. A federal jury in Chicago ordered Microsoft to pay $521 million to the University of California and Chicago-based Eolas Technologies Inc. for infringing a patented method of accessing interactive programs with a browser. Eolas' lawyer has said the company will seek hundreds of millions of dollars more in royalties. The jury award was based on royalties for units sold between November 1998 and September 2001.

whatever they do, it will probably take a long, long time to actually affect webmasters because most surfers wont be updating...

I just saw another company also that is claiming they have the patent for digitally signed transactions on the Internet.
That could be another nightmare in the making.

I think I read about this a few weeks ago and I think other browsers are in violation too.
I can't believe how fucked the courts are to award these types of rulings. I'm sure they are appealing. |

this patent covers use of any embedded program objects, or applets within Web documents, and any computer program product for use in a system comprising of at least one client workstation and one network server so flash would be in violation if it gets data from an external server, LAME, i make a living off flash games and anything as llittle of a high score list would put it in violation. DAMN alot of online games would be in violation, actually ALOT OF SHIT would be!!!

i have to side 100% with the courts. otherwise what good is a patent. sorry, i guess microsoft should have done their homework.
to say anything contrary would be 100% anti-capitalism and anti-american. And since M$ is a U.S. based company any problems they have with this violation are unjust. I do side with M$ on the money issue... if anything they are losing money by making a free browser. they have to pay people to write the code, troubleshoot, beta test, customer support personnel, i say the patent holder cuts M$ a check to help soak up the loss they take on IE. I sure as hell do not see how they are making money off it... so if the asshole patent holder wants part of the action, let them have it... Where does the $521,000,00.00 figure come from? Plus royalties?!?!? What royalties... Somone needs to shoot the fucking idiot who awarded this sum. if anything they should have ordered microsoft to put the order of coding a new browser as job 1 or face penalites if they did not comply by a set date. but no money should have been paid out to the patent holder. unless i am missing something and microsoft is making money off IE... maybe the patent holder tried to infer that an end user purchases an operating system not only for the os itself, but also for the software (deemed free or otherwise) bundled with it... or maybe i am just talking out of my ass. |
