Here is an idea for you, how about reading all the posts in a thread. It is extremely relevant. Yes, he could probably sue Brad for infringement. What would he collect? Little to nothing. Damages in this case are minimal, if even existent at all. In addition, FUBAR pics are hotlinked and used all the time, has he sued all of those people as well?

Once he is done suing Brad for CI, he can expect that he may be sued by every person in every picture on his site for misappropriation of likeness. I see mega damages there. Private citizens, attending private parties, having their image and likeness published on a porn webmaster board. Believe it or not, there are a lot of people in our business who don't tell others what they do for a living.

All those people were at private parties with loads of photographers taking pics; with JFK taking pics for his website which has only pics of webmaster events.

That point aside, i think it is wrong to take someone else's photo and put it on your server.

What I think is funny is how people twist things.

When sexeducation had stolen pics, no one was on his side.

Some time ago there was a public event photographer that had his pics stolen, people were on the photographers side.
Someone stated that the photographer had the law on his side.

Now we have the same issue, but now people (at least JMM and Brad) are NOT on the photographers side.
They state they have the law on their side.

I thought the issue with GGW, is that the people that appeared on film *knew* there were photos being taken of them, due to the general activity of mardi-gras, and the fact that they have a dozen lens shoved in their faces.

To me, if you value your privacy, and dont want anyone to know that you are involved in the adult industry, then you dont go to conventions; least of all to wild porno parties which are world reknowned for their photographic reporting.
