Acacia - post on stock message board....

http://finance.messages.yahoo.com/bb...0497&mid=19742

Quote:
Acacia patent is very much valid. I wish it was not, I am being sued myself.

The adult industry top 50 companies make 90% of the money and sales. The rest of the 1200 or whatever companies are worthless for Acacia to sue but they did to win easy settlements and set precident.

The adult industry is the biggest money making industry on the internet, HANDS DOWN! Dont fool yourself thinging anything other. And all the companies sales are growing every year.

I know companies are settling as we speak, large companies and small companies. Its happening!

Yes to fully get the most of the patents some companies will fight for 2-3 years... But if the patent is being validated all over the place and 100's of companies are settling, those fighting the litigation will soon end up loosing and then end up paying for back years.

I'll hold my shares, I know companies are settling and this is PURE PROFIT earnings for Acacia every year from here on in.

No sales last Quarter, well wait till Q3 then Q4 you wanna see GROWTH!

I am definately going to purchase more shares, I am in the red my average is over $2.00 will try to get the bottom here soon.

Good Luck to all

Gee, I wonder who posted that bs.

their patent. Nm this is GFY, spelling doesn't count.

But anyway, Huh?

The only solid solution I know of is to invalidate the patent through prior art.

These guys aren't going to just go away when people come up with crazy macgyverish ways to circumvent it. They'll just sue ya harder. I mean why not, they have legal staff on the payroll & odds are you'll fold under pressure.

A victory for the IMPA or the using the methods fiveyes mentioned last night are the only ways I see to possiblymake them "go away". (since odds are they will just appeal if the patent is invalidated - right?)

We shall see, I would not make such bold claims if my legal team has not only approved it but blessed it.

My solution is not covered in their patent...their patent is very clear on what it covers. Our solution does not infringe on the patent.

We are also donating a portion of our sales for this solution to the IMPA so either way its win win for the adult world.

But I should shut up now...I've allready said to much

Here is a great followup though:

http://finance.messages.yahoo.com/bb...0497&mid=19746

This about sums it up....

Quote:
Many of the adult companies will not settle no matter what the deal and will fight until an appellate decision tells them otherwise. Many will take their business offshore to jurisdictions beyond acacias reach. Even those that settle will likely only do so if there is a sweetheart deal on the table AND they will also likely still give LOTS of money to the IMPA and pump up the defense fund with that law firm Fish etal. Acacia is in for a real dog fight here and the truth of the matter is that there is not alot of money here that would justify it.

That post is funny because the person is probably just trying to get the price back up so he can dump it.

A patent is supposed to be 100% clear on what it covers, the problem is when a patent holder takes a narrowly defined patent, and tries to apply it in a broader sense.

There is a multitude of patents filed for streaming audio and video and the transfer of digital audio/video. A good majority of those are specific to the technologies that the inventor created.

My website and my point of view is not saying that patents are bad, on the contrary, patents are good for what they were intended, to protect inventors right to what they created, and to share that knowledge with others. Patents are now being used to just sue people for "business methods" that means they don't have to actually create anything.

Acacia and other companies like SightSound patent are troubling because they are broad in what they are claiming.

We need to shoot down Acacia's patent claim by finding prior art pre-1991.

If you think your method doesn't violate their patent, or the hundreds of other ones out there, then you need to spend more time with you IP/patent attorney.

I think some old timers would remember streaming audio when they tied a rope between two cups... that's not patented.. and that method would be safe from Acacia's and all others patents.

I applaud your intentions of donating % of the proceeds from the sale of your audio/video distribution system, but besides being able to fight off any patent claims like Acacia, i guess that would mean people have to buy your solution first....

The choice is very simple.

On one hand you have a bunch of lawyers who think we are low hanging friut ready to be picked.

On the other hand you have companies big and small that fight every day to stay in business.

Give in to Acacia you will find they have another patent that they want us to pay a royalty on, or maybe another bunch of lawyers will find another patent to come after us with.

Also you are also assuming that when Acacia start mopping us up they will be happy with 2%, they started at 5% I believe, what is to stop them asking for 10% or joining with the biggest players and forcing the rest out of the market?

Does it say in the license that it will be 2% for ever or just year by year?

They picked on us because they didn't think we had the stomach for a fight, if this patent was worth diddly squat Acacias shares would not be going through the floor.

American justice is decided very often on the amount of money you have. Acacia planned that we would roll over with the Domino effect. They actually have filed an action because we stood up to them. They are frightened now that whether they are right or wrong we can out spend them.
