We shall see, I would not make such bold claims if my legal team has not only approved it but blessed it.
My solution is not covered in their patent...their patent is very clear on what it covers. Our solution does not infringe on the patent. We are also donating a portion of our sales for this solution to the IMPA so either way its win win for the adult world. But I should shut up now...I've allready said to much |

If you think your method doesn't violate their patent, or the hundreds of other ones out there, then you need to spend more time with you IP/patent attorney. I think some old timers would remember streaming audio when they tied a rope between two cups... that's not patented.. and that method would be safe from Acacia's and all others patents. I applaud your intentions of donating % of the proceeds from the sale of your audio/video distribution system, but besides being able to fight off any patent claims like Acacia, i guess that would mean people have to buy your solution first.... |
The choice is very simple.
On one hand you have a bunch of lawyers who think we are low hanging friut ready to be picked. On the other hand you have companies big and small that fight every day to stay in business. Give in to Acacia you will find they have another patent that they want us to pay a royalty on, or maybe another bunch of lawyers will find another patent to come after us with. Also you are also assuming that when Acacia start mopping us up they will be happy with 2%, they started at 5% I believe, what is to stop them asking for 10% or joining with the biggest players and forcing the rest out of the market? Does it say in the license that it will be 2% for ever or just year by year? They picked on us because they didn't think we had the stomach for a fight, if this patent was worth diddly squat Acacias shares would not be going through the floor. American justice is decided very often on the amount of money you have. Acacia planned that we would roll over with the Domino effect. They actually have filed an action because we stood up to them. They are frightened now that whether they are right or wrong we can out spend them. |
I am definately going to purchase more shares, I am in the red my average is over $2.00 will try to get the bottom here soon.
