Acacia ??

Ok so far i understand acacia has been going after people with videos on their websites.

What if you -

Have a company offshore,
Process cc# using the offshore information
Host the videos offshore ( Or host them in a US server using offshore company info)

Now how would they find you? Would they send a letter to nevis/bahamas ??

I kinda think if people move completely offshore they are fine from all these laws and lawsuits,

someone said if you are in USA they will sue you, but how would they know that (since all your domains are registered under your company in nevis/etc)

?? This would work wouldnt it?

It's not just in the US.. Acacia has patents that are also in various countries overseas and in europe.. so it depends on where you are. Canada isn't covered, as are some other european countries.

What im saying is IF EVERYTHING you have is gotten under your company name in nevis/etc/

Like hosting, processing, etc

Would they try to sue you there? I figure its impossible to sue someone in Nevis..

They own patents all over the world, yeah, but not in every country. I doubt they can do shit in bahamas or nevis.

Do you really want your money making business hosted in some ass backwards third world country that won't acknowledge other peoples worldwide patented intellecutual property?

Or start messing around with Visa/MC and US regulations?

All to avoid paying these bloodsuckers 3% of your income?

You can run but you can't hide. You would have to also MOVE out of the US (if that's where you live), because no matter where your business is operating from, if you are living in the USA then they can get you.



And there have been Canadian webmasters already served papers, so Canada is on the Acacia list.

Well, go ahead and chance it then. But you can either look for little loopholes and try to squirm out from under the gun, or you can help fund those who are actually doing something about it. I would rather open my wallet now rather than go to all the trouble and expense of running my business off to hide in a foreign country.

And when you're done donating to IMPA (if all you've got is $5, donate it! It will help!), start looking for ANY documentation regarding the compression of video & audio for digital transmission that was published prior to 1992.

Hi-tech magazines, radio magazines, research papers, doctoral essays and theses... *anything*.
Document anything you find and send it to Spike: spike AT homegrownvideo.com.
Any documentation like this will help establish a 'prior art' claim and render Acacia's patents INVALID and would be of significant benefit to IMPA and anyone who's been served.

How about this idea...

I host the video in my ass. When one of my customers wants to watch the video, instead of clicking on a link, they come over to my house and I bend over and spread my ass cheeks.

My wife can serve beer and popcorn (for an extra fee of course..there is no way I'm giving them beer and popcorn as part of their regular membership).

The only way to stop this is to invalidate the patents. The defense group, and the IMPA, believe that the Acacia patents are invalid. We will vigorously fight to invalidate these patents in a court of law, to protect ourselves, our business, and our industry.

Get a host in Thailand or China you will be safe there at least in the short term. But remember this. If ACACIA wants to sue you they have to present the papers to you in your country not in the USA, so unless they had representation in each country they would have to hire a company or individual to serve you the paperwork. Seems like a lot of trouble and the easy targets will be in LA areas near their base of operations. We have an office in the USA and a USA address but our head office and the residence of our CEO etc. is the UK. So they have to present our papers in the UK and good luck with that.

Best plan of action is to file complaints with the FTC as was suggested yesterday file as many small claims as possible and support Home grown Video in their fight against these assholes. Every $100 you give would be a great help to them.

Hi.
I have non movie sites or other things where i tranfer movies to the surfers but i am right now reading the danish patent on the system.
I realy don't thing that cover movie and audio transmision on the internet today.

1. On the patentet system all movies is uncompress, then the buyer ordre them.
2. the surfer can tell the system what format he want it compressed to
3. The system put a ID code on it then it compress the movie
4. It will be playet on a time the surfer have ask the system to show it.

As i see it: It looks more like a movie on demand system than a movie transmision system
