not paying royalties. Have your company that has no sales serve them for free for your paysites as an act of kindness.

That is actually quite a clever idea.

You could make it better by leasing 'parts' of servers from every hosting company going. The parts of the server are the 'parts' which host the videos. So when someone rents a dedicated server they rent one part for the pics, code etc from the hosting company at there current going rate then the other part from 'Zero Income Corp' to put the videos on it.

My idea is patented and I require 10% of what you save by not paying Acacia. Please make checks out to asneed and print this thread and attach it.

the other company would just be contributing to infringement by making profits from linking to the videos

All you people who think that trying to circumvent Acacia's terms and find loopholes in their licensing are fools.

ACACIA DOES NOT HAVE TO LICENSE YOU THEIR TECHNOLOGY.

If you try to be sneaky and dick them around, they'll just say "License revoked! NEXT!"

And you guys are posting about it here, Acacia's little crones are crawling the boards, taking notes, and they'll have any and all holes in their little extortion package fixed so that your ideas won't work anyways.. Don't announce this stuff here if you're serious about figuring it out :P

the problem is they would sue you for it.

the only way to deal with acacia is to make their patents invalid.

Yep, this is what it all boils down to.. They have to be beaten in court. You can come up with all the little scams you want to get around it, but the law will get you in the end.. If you beat them legally, there's fuck all they can do about it.

Acacia isnt going to win any of their court cases where the people actually show up.

We can certainly hope.. Let's hope Microsoft takes a more active interest in things too.

Please admit to everyone that you are just randomly pulling shit out of your ass here.

Acacia is a company of attorneys. They love to go to court and fight. It's their thing.

And if you are a small guy with a small time attorney, all the better. It's like a little sparring match for them.

Have you even done any research here? Or do you just start shooting out this wisdom like you have a clue?

Go do some reasearch. Acacia spends half their time in court.

I'm not pro-Acacia, I'm as anti as they come.

But when people start spreading around bits of wisdom on ways that they can try to sneakily get over on Acacia, or all you have to do is show up in court in California and the whole thing magically goes away - then something needs to be said.

Microsoft likely doesn't have a licence yet, so there isn't anything to revoke.

When did they send Microsoft a packet?

I've been paying attention to the news and the facts.

You obviously haven't.

If you think you can sit on your ass and come up with ways
that you will personally make this team of attorneys gunning for a portion of your sales go away, then you have another thing coming.

So your message to people here is "Don't believe a damn thing until they go up against Microsoft!"

It's been said 100 times before, the people at Acacia are not fools.

Using your logic, hey they should just go straight to Microsoft, pick up their billions and head to the islands to live out the rest of their days in luxury.

Understand this:

They will NEVER go to Microsoft, and yet, they will suck up tens of millions of dollars from several avenues without getting to that stage.

So they failed right? Because they didn't take Microsoft to court?

Where do you think the tens of millions will come from?

Go look in the mirror for awhile & hold up your bank cards.

Heh who here does have a license? Just about no one. So why did you even mention revoking it? Whats the point of revoking a license when everyone on the net serving video doesnt have one except CE

If you want to stop Acacia you have to invalidate their patents.

This is not something that can be done in a day.

With IP cases, you can have mounds of prior art, everyone in the world can know in retrospect that the patents should not have been issued in the first place.

And yet, there is still a process that needs to be gone about to invalidate those patents. That process takes lots of time and lots of money. Usually upwards of a million dollars.

Want to help?

Stop telling people to come up with ideas on how to get around Acacias licensing (in which they'll probably revoke any license you had with them anyway) and start telling people to:

wake the F up and DONATE TO THE IMPA

jesus christ.. you guys keep repeating the same over and over again..

Finally i have a reason to blame acacia for something evil:
they exploit retards and kids.. no fucking wonder.

Reading all these posts makes it obvious ANYONE (with or without a patent) can fuck you guys over.

Acacia can see your fear and stupidity in every character you type.
Hell, even i can see it. You guys have NO clue how to deal with
these kind of things and you start screaming like a bunch of kids.

Think about that and start doing something productive instead
of making up inspector gadget scenario's.

I understand that they want a % of the gross income. Now most paysites consists of many features including pictures, on line magazines, etc...

In the event that they could enforce their claimed patents, shouldn't it be wise to split up our sites in such a way that only the income from video would be subject to royalty payment?

Such as having a signup pages that clearly specifies that $ 10.00 is for pictures and trhe extra 19.00 is for the video accesss. Maybe even set-up a non-video content acces for that $ 10.00 to make it plausible...

For the moment, I am in Canada and we fuck Acacia daily.

Atari you are an idiot. I never said they HAD to go up against Microsoft. I never said they would. You are using my EXAMPLE and taking it as a statement. They wont go to Microsoft because there is no chance in hell of them winning.

I NEVER said they failed if they dont take Microsoft to court, you pull that shit out of your ass. They will suck up tens of millions of dollars. And anyone that pays a dime of that is a complete fucking idiot. In a year the people who havent paid anything will be laughing their asses off at the ones who did. I'm done with this.

On the contrary, you are using your example as a way to make Acacia seem like less of a threat "because they will get slapped down in a heartbeat when they go up against ____________".
Not intentionally, I'm sure.

They probably don't even have any plans to go up against Microsoft, or Apple, or anyone "big" until they have had many in and out of courtroom win's notched under their belt.

It's just bad information to throw out there, because it really doesn't apply here. What Microsoft COULD DO if they were forced to face Acacia is completely irrelevant, since they are not being required to do so.

This pointless trash stop has to stop.

We as an INDUSTRY need to be a little more realistic about this. We need to stay focused and organized.

What if Microsoft or another big company decided to pre-empt Acacia and invalidate their patents? Any company using video is at risk, whether Acacia has plans to go after them right now or not.

You are not even worth talking to. Did I say anywhere in this thread: Do this and nothing else. Do not see your lawyer and do not show up in court. No I didnt. I'm throwing out ideas and suggestions. You are taking them way too seriously. Get a fucking life.

Setting up a corporation as a legal shield only will not work in the long run. A plaintiff could "pierce the corporate veil" under such circumstances, and imput liability on the individuals behind it.

The long run? Their patent expires in 2011 and will be invalidated way before then. What long run?

I agree with you on this and had some other thoughts on it even if their patents were proven valid. The way they have gone about their claim is rediculous. I just choose not to mention them here because of threads like this. It's a bunch of kids yelling about how they, out of the millions of people online know how to beat Acacia and their lawyers.

"Piercing the corporate veil" is just an additional step a plaintiff must accomplish when seeking to imput liability to individuals behind a corp. It would be part of the same lawsuit.

Your corp idea isn't a bad one, especially if you're trying to look like an unappealing target. I'm just saying it doesn't offer much real protection, and could hurt more than help - once personal liability is granted by the court.
