The government does not provide our e-mail addy's for us and control the networks. The internet is private. If Microsoft doesn't want you sending email ad's to their customers, then stop or be sued. Simple as that.

make sure you are a valid double-opt and do everything by the book or do not bother- you are right-ish

lawsuits are very expensive

The point is NOT what Ev and Michael did or did not do. That is for a judge or a jury to decide.

The point is that all these fuckers sit around and cry about shit and how it's always someone starting it, and all the while who knows what they are doing.

The case never made it to a jury.

Cambria and firm had me stay silent back then- people published some opinions and some people published false accusations. Now we can publish our responses. 16 months in internet time, is like a decade- I hear you.

Evan and Michael have always shown they have integrity and class in all of their dealings with me over the years. They are innovative and exceptional businessmen. I have complete faith in their being proven innocent in this matter. Some people around here have nothing better to do than jumping to conclusions and tearing people down. If you are looking to do business with an ethical and honest program that will make you money and pay you year after year theres none I would recommend more than Xpays!

Joe Segal

When the shock of the suit hit me, a post like this was very refreshing and thanks as always Joe.

I agree wholeheartedly, Joseph!

What some webmasters fail to realize (or care to), is that Xpays does not hide who they are ... they're not hiding behind offshore entities like BIG SPAMMERS do. If you do a whois on any of their domains they point back to XPAYS in San Francisco. Why? Because there are no reasons for them to hide.

Any company that does email marketing or runs an affiliate program could easily be a target for a lawsuit.

READ: Any program can have affiliates that SPAM, spoof, or anything else underhanded, and the SPONSOR will catch the blame.

In this case, it's a lawsuit spearheaded by Microsoft that looks more like a PR campaign to say:

"Look, we're cleaning up OUR email services and going after NASTY SPAMMERS ... come sign up for a Hotmail account or an MSN account ... you're safe with Microsoft"

Whether or not the SPONSOR can prove their innocence is of no consequence. If they're targeted, at the very least - they're going to have to fight a costly legal battle.

My belief is that Xpays will come out of this and be exonerated!

Just my :2 cents:

The benefit of the doubt :thumbsup

today we got bounces one by one to each of our past and present employees emails- rather than the usual dictionary style. There is no way "inhouse" applies to our current staff. Spamhaus has some info relative here that points elsewhere.. please forward any info..

email details please- evan @ xpays.com
