Is APIC on crack???

Just got email giving notice that I was in violation of copyright infringement..

Had my name, address, email, etc.

but the domain/content that they were referring to doesn't even come close to being mine..

I don't do infringement stuff.. not worth having to keep lookin over my shoulder..

Soo.. Apic needs to get their ducks in a row I'm thinkin..

Could it be someone you host on servers (IPs) registered to you?

What is the number in the Subject line?

Also make sure the APIC PGP signature is correct. It might just be someone fucking with you and wanting APIC to get the blame.

Well this is strange..
I can see now why they thought the site was mine..

I have a2z-adultvideos.com hosted at smutserver..
When I ran a trace on the name, it resolved to
64.156.26.25 - a2z-adultvideos.com ..

I then ran a trace on the offending site:
http://www.real-xxx-xxx.net/xxx/gal1.htm and it too resolves to 64.156.26.25 - a2z-adultvideos.com

Anyone know how this can happen?

I have no ties to this site in any way.. never heard of it til today..

if you are supposed to have a dedicated IP, it looks like that not be the case.

Smutserver should probably be the one you ask.

I'm just curious as to how doing a trace on it can resolve to my domain name.. kinda creepy..

I sent mail to smutserver support to see if they could explain the weirdness..

APIC is pathetic, what just happened to Scootermuze is an example of how completely ignorant he is of this business and the Internet in general.

When u get the letter from APIC does it tell you which producer they are acting on behalf of? Write the producer and tell him that you do not like being harassed and accused of crimes by their agent APIC and that YOU are considering legal action now. Yes, I know APIC didn't do it maliciously but it is EXTREMELY negligent to accuse somebody of stealing when you can't back it up.

Tell smutserver to take your domain name off the IP if it is not your dedicated IP, they can put their own on and you won't want to get notified for other people's infringements.

APIC goes with the information that is provided -- no other way to do it. If it is not accurate and you get wrongly notified you should talk to those that need to correct it.

They are the ones in error. .... and "pathetic" is a word for people who complain and call things EXTREMELY NEGLIGENT when they aren't.

get your facts straight. even the newbiest newbie KNOWS that the MAJORITY of adult sites are hosted VIRTUALLY sharing IP addresses. It is NEGLIGENT to send a DMCA letter to a web host accusing a specific webmaster of stealing content when all you have is a IP address the domain resolves to. Understand?

The letter should have gone to the hosting company who could figure out which customer the complaint was lodged against.
Scootermuze's name should NEVER have been involved.

Mutt, do you think the concept of APIC is a good one, but in this case it has been poorly implemented, or do you think that the model is flawed.

From what i gather, content producers pay a fee, and APIC "prosecutes" / chases up on infringements that the producer points out to them (?).

Seems like a pretty good idea, to have one organisation who is experienced in enforcing copyright protection / can utilise economies of scale.

or am i way off base?

Just a sample of how APIC works: this happened to me with Suze Randall's content, I got one of those (in)famous APIC letters and I sent them a mail explaining that the material was licensed for use in the terms of Suze Randall's Pics4Clicks program. They answered back telling me I'd take the images off inmediately. I was pissed like hell, now, but still sent them another "good boy" mail, this time CC Suze Randall. What they did? They threatened my hosting because they were hosting "stolen material". The best part: a paragraph were they said something like I was worng because they "never make mistakes". I talk to Suze and she explained everything CC to my hosting and after some more mails and threats by these birdbrains, they stopped harrassing me with a final mail telling me again that "they never make mistakes". Today, if I see somebody from APIC personally and I have a fork in my hand, I drill it in an eye.

Anyway, beware of APIC, because "they never make mistakes" . Ah, btw, they intended to do this joke twice after that and I simply ignored them and talk to my server and Suze (it's always about Suze ), I've no time for clueless dumbasses

Sad thing is the idea is great, it would be nice if somebody with an IQ higher than 16 could run a service like that. And the proof of their stupidity is that without the need of being an "APIC detective" I'd find no less than 1000 pages a day with stolen content. But they can't so go figure

Well I tried to be nice to the guy in explaining what I felt the problem seems to be, but he comes back with the deal that the ip resolve issue is my problem and I should take MY site down or I would be responsible for the infringement.. THEN he sends another email saying that, "These Russians are capable of anything..." so he'll give me the benefit of the doubt.. even though he questions my name because I used my first name on the domain registration and signed my emails with my middle name.. which is what I go by.

This guy must feel really important , but he's gonna see just how important he is if he gets me mixed up in this fiasco.

The concept of apic is a good one, but it is poorly implemented. Apic likes to shoot first and ask questions later. On one hand, I can understand that mentality because one is bound to become jaded when dealing with crooks and idiots day after day, but on the other there really is no excuse for acting irresponsibly.

I have never let my feelings about APIC be a secret.

The guy is a pushy moron who gets off on picking fights. He was probably the guy that got beaten up for lunch money daily. And now he's trying to take it out on the real world by picking fights with anyone he thinks he can.

I got a C&D from him as did my providers and billing companies over my own content.

Can anyone that knows him please remind him that he's not a lawyer and it's against the law to pretend he is one?

Finally!

I just got one too for a site I host for someone and help out on. I was beginning to feel left out. Now after all these years I feel I've finally made it.

As is often the case with the APIC idiots the content was very licensed. It was actually part of the huge $17k prize giveaway thing that she won end of last year.

Surely someone out there with a little intelligence and a basic grasp of this business and the legal side of things wants to start up a company that can do APIC's job properly. The service is needed. The idiocy and unethical bully boy tactics aren't. The only shame is that anybody in this business from hosts down actually take any real notice of this guy.
