Two Years Prison For Porn Spam: New House Bill

WASHINGTON? A new U.S. House spam-socking bill includes a provision to make it a federal crime to spam porn, unless the spammer is in line with regulations being left to the Federal Trade Commission to compose.
And those who violate the porn spam provision could be hit with prison terms of up to two years, according to the bill's language.

This measure is part of a bill being called "Reduction in Distribution of Spam Act," written by Rep. Richard Burr (R-North Carolina). CNET.com said May 23 the Burr has the best chance of any anti-spam measure to pass the full House, since it has two powerful committee chairmen supporting it: House Energy and Commerce Committee chairman Billy Tauzin (R-Louisiana) and House Judiciary Committee chairman James Sensenbrenner (R-Wisconsin).

The bill would ban unsolicited e-mail without letting recipients unsubscribe, valid return e-mails and street addresses, and makes plain that the message is a solicitation, CNET said. Those opting out may not be contacted again by the spammer for three years. Internet service providers would be allowed to sue for damages equaling $10 per each mail sent to an opted-out recipient with a maximum of $500,000, and a judge deciding the spammer did it knowingly could triple the damages to $1.5 million, the tech news Website added..

The bill would also let state attorneys general sue over false header information up to $3 million, under FTC and U.S. Justice Department jurisdiction, and they would also get more power to sue those who didn't include legitimate identification in the spam messages.

The Burr bill emerged just as California's state Senate passed a measure to make it a crime to send spam and to let recipients sue spammers they can identify for $500 per spam message. Written by state Sen. Debra Bowen (R-Redondo Beach), this could become one of the toughest spam-fighting laws in the United States, assuming it passes the state Assembly and embattled Gov. Gray Davis signs the bill.

Earlier this year, a bill began making the rounds in the Arkansas legislature to force porn spammers to include warnings, be traceable to commercial distributors, and include a sender's actual name, address, and source computer identification number. And there isn't as much sympathy for porn spammers around the professional adult Internet as some might believe.

"They're sending this stuff indiscriminately, and they're sending materials that are offensive to recipients, and those people are calling their Congressmen," Free Speech Coalition Bill Lyon told AVN Online earlier this year, in as much a warning as a factual analysis of the porn spammers. "You can't send a little blue-haired lady in Pasadena pictures of people screwing and not expect her not to react by calling anyone she can think of."

Lyon had added, however, that one problem lawmakers might run into is the volume of porn spam originating outside the United States. "Nothing we do is going to control that," he said. "?And you can't determine how much is the offshore stuff. But it's not letting up."

It doesn't sound like a bill banning spam, it sounds like a bill banning forged spam with no opt out.

I didn't read the bill, just some of the article.

I'll tell you that I'm FAR less bothered by porn spam than the mortgage toner penis pills world's smallest camera shit.

The answer isn't legal, it's from the ISP's and the people selling the stuff.

hmm..i guess there is not much they can do if it is coming from outside of the US?

looks like they are mostly focusing on the people who just send out without any real plan anyway...any mailers that i have ever known don't wast their time sending anything to anyone that doesn't want it....it is just one small step in watching your lists.

plus it still has to go through and be passed...and i don't think the R for Republicans will be in next term

spammers have done this to themselves and all I can say it It's about fucking time!

They send emails with fake names, fake email addresses etc and still say "We aren't doing anything wrong" ha why hide then?

Although this now means that spammers from other countries will make all the $$.

You guys have no idea,, you actually think this is a good thing for government to get involved,,

if something like this will go thru then you can just say good bye to lot of Email sponsors and lot of other Per sign up sponsors who rely majority of thier income to mailers,

there is a thin line between spam and opt-in newsletters.

thank goodness i know the story of how a bill becomes a law

The line is crossed when you take a real opt in list and sell it 50 times a month to people who forge headers and each send 10 mailings a day.

If you run a real double opt in list, how is this law going to hurt you?

I'm not saying I support the government getting involved in the adult industry, because I generally do not. I just wonder how you think this will hurt real double opt in mailers.

How is the law going to hurt the legit opt in mailers??

Very simple.

They will go to company that has an opt in list and say, you have been accused of spamming. We have gotten x number of spam complaints about you, so we are taking your computers and all of your money and your home. Now if you want to fight in court, we would be happy to see you there.

So now you have a company that had a legit double opt in lsit going, and all of the employees are in deep shit!!!

The company does not have the money to defend themselves, and the people have to start over.

Because they can not pay an attorney, and no attorney will defend them for free, they are fucked. And the company that they fought so hard to build is smashed and gone...

The good thing that comes of it is that the politicians will get a nice fat chunk of your change...

And it will hurt the entire porn industry.

The really sad thing is that they are mostly going after the porn e-mailers. I guess that they guy sending 1 million e-mails a day selling insurace is ok!!!

After today...I have to say good.

I'm getting 1,000 per hour from the same person, promoting the same 120 sites for $2.95.

Not 1,000 per day...I'm getting this many per hour. If anyone deserves prison time for spam it's this fucknut.

because even those of us who run double optin lists with actual subscribed to newsletters get complaints as well...people hear they are going to get a $500 per spam payday will complain about every single peice of mail they get in their inbox...
and do you really think some hick nazi senator is going to know what the difference between solicted and unsolicted? if someone double opts into my financial newsletter and decides he wants a $500 payday and tries to turn me in for spamming, I'll be not only highly pissed, but I would expect that I should be able to countersue for damages arising froma false complaint...

on that note, I'm out of here...heading to Arizona for the weekend....anyone want to go in my place? I don't really want to go....hillbilly in-laws and all that shit...

The huge problems with bills like that is simple:

The spamers sit in Asia and hack into your computer to use it as spam relay.

Now how do you defend yourself if all your computers and servers are seezed by the Feds? Your business is down the drain before you can prove your innocence if you can ever prove it.

So the real spammers you never get but the small fry opt in mailers that try to operate legaly will get fucked with full force of the law.
