Germany Passes "Orwellian" Anti-Free-Speech "Facebook Law"


The writing has been on the wall for months, but German lawmakers have now passed a controversial law under which Facebook, Twitter, and other social media companies could face fines of up to ?50 million ($57 million) for failing to remove hate speech.

As AP reports, the measure approved is designed to enforce the country?s existing limits on speech, including the long-standing ban on Holocaust denial. Among other things, it would fine social networking sites if they persistently fail to remove illegal content within a week, including defamatory ?fake news.?

?Freedom of speech ends where the criminal law begins,? said Justice Minister Heiko Maas, who was the driving force behind the bill.

Under the law, social media companies would face steep fines for failing to remove ?obviously illegal? content ? including hate speech, defamation, and incitements to violence ? within 24 hours. They would face an initial fine of ?5 million, which could rise to ?50 million. Web companies would have up to one week to decide on cases that are less clear cut.

Aside from the hefty fine for companies, the law also provides for fines of up to 5 million euros for the person each company designates to deal with the complaints procedure if it doesn?t meet requirements.

Social networks also have to publish a report every six months detailing how many complaints they received and how they dealt with them.

Maas said official figures showed the number of hate crimes in Germany increased by over 300 percent in the last two years.

But human rights experts and the companies affected warn that the law risks privatising the process of censorship and could have a chilling effect on free speech.

Newspapers are responsible for what they print. TV is responsible for what it broadcasts.

Facebook, Google, Apple et al are businesses, and these companies have created a whole new level of power and profitability based on them being "platforms" that are not responsible for their users content.

Problem is that "obviously illegal" is often not so obvious. For example a phrase like "deport all immigrants!" could be just someone's harmless opinion, while someone else could consider it "hate speech."

there is no perfect solution...but something has to be done...hate speech leads directly to violence and war/civil war...there are courts where one can argue his case afterwards if they feel it was not hate speech...

the point is that freedom of speech ends at the point where it influences other peoples freedom.

I agree! People are bashing and humiliating others and nobody was doing anything about it, and the worst part is that they're doing it while hiding behind the social media sites.
If someone has something hateful to say, they can write it on their house walls or their car windows, or carry a sign saying in big letters whatever it is they want to say. If it's that important that they HAVE to make it public, then why hide online and not do it in person?

i prefer to be stopped by a german police officer as by an american. when i go though german security and i don´t like it i CAN complain it - you guys can not because you will end up a night in jail.

The only question here that really matters is -> Who decides what's "hate speech"?

Is it an official court that makes it's decision based on the actual law? Or is it i.e. Facebook?

If it's not an official institution than it opens the gates for censorship, everything that's not mainstream could be "hatespeech" or "fake news"...

well that law can not tell facebook how they can act but if there is any content what is not allowed it is an official institution to ask them to take it down.
actually that institution was existing before but they had no power to force them to take it down.

Aside from drinking in public I'm having a hard time figuring out what freedoms you're referring to. Germany is the country where you're fined for not recycling. US has more freedom when it comes to marijuana use. The US also has much better gun rights. Driving licenses in the US cost $60 at most and are easy to get versus the $1000-1500 it costs in Germany.

In Holland they want to ban the smaller parties by introducing a minimum of votes. That is cause there are too many parties (they say) and they can't form a majority at this moment. But i agree, the system in the USA is bad, better if all people have some to say what direction to go.

And look what they did in Holland, important statistics of crime committed by refugees wasn't open for public. After a newspaper started proceeding they had to give it in the end...

That 'hate speech' doesn't come from nothing. There is a reason people talk bad. Now again in Sweden, a festival is cancelled cause there where rapes and sexual abuse.... That hate is triggered. And as long you don't solve that (and it showed they can't) 'hate' speech is not going anywhere. It is just ment to shut people up.

The refugee problem is the most dangerous thing in Europe at this moment.

Multi party proposals will not work in the USA unless there are candidates in the Congressional races.
