iBill New Cross Border Aquiring Regulations

Got this from my REP

I wanted to bring this to your attention before you were sent an email Monday.

As you are aware, Visa and the other card associations have classified iBill as an IPSP (Internet Payment Service Provider). With this, there are some new regulations that iBill must adhere to. One of the regulations deals with cross border aquiring. This means that as an IPSP, we can only accept transactions from merchants that are located in the regions in which iBill has banking relations.

Today, iBill has banking relationships in the US and EU regions only. Shortly, iBill will not be able to accept transactions from our merchants located in Canada. Hence: I wanted to make you aware of this ASAP. As I mentioned, communication should be going out to all of our clients regarding this issue in the upcoming days. In order to continue to process through iBill you will need to have a presence in the US or EU regions.

Long story short.....A good biller, one of the top 3, moved me from USA processing to their UK branch. I am Canadian. I asked one of the owners about it....am I safe from Visa regs. This was about 3 months ago. He wrote back and said "my best advice at this time is to establish a UK presence." He didn't say I had to, but advised I do.
I also contacted a processor based in the UK, about a month ago, and they said the same thing. In fact, they wouldn't even set up processing unless I set up a UK presence.
Personally, I only think it is a matter of time. I am still getting signups under my UK processor with no Visa fees, but....it is only a matter of time before I have to set up a UK presence, which as far as I know doesn't require the $750 fee, but requires a presence in the UK. And when I checked prices to do it, it was outrageous. Just my experience, yours may vary.

if you're with an ISPS you SHOULD already have a presence, not just a mailing address there. If VISA checks, you're fucked.

why not just use ProBilling who have real offices in Canada and skip the app fees, and the whole myriad of bullshit with the theives at iBill, etc. ?

If you are a Canadian with an EU presence do you have to have your bank in EU?

Current address is in Ontario Canada, I noticed that myself, so I don't know what the scoop is here. I had a lot of problems with physical address vs. mailing address, they couldn't get it right.
