Directnic Drops My Ball

Just a warning about Directnic and how far they won't go for adult webmasters...

In March a certain well known asian country allowed registration of TLD's. I grabbed a few very very nice ones. Now I know that this country has very strict rules in regards to domain terms. You can't register domains with the seven bad words...So I stuck to double entendres and some obscure but very sweet terms.

Now many will say that any domains other than .com are worthless, but you have no idea what you are talking about. If you know how to sell in Asia these domains are gold, and I will park my Porsche's on your lawn to prove it.

So anyways I email directnic a few days after registration to ask why my domain is not resolving. They say it was declined by the TLD registrar as being a term that is not allowed.

Well I just check and now some other fucker has my domain up and running, registered through a different registrar.

Directnic it seems NEVER EVEN BOTHERED to try register with the TLD. They made an arbitrary call that has cost me something very valuable. Has anyone been through an Icann dispute process? I guess I am actually going to have to sue these guys. The domain is rightfully mine.

And as a less than funny side note, the guy using the domain is an AP affiliate 164119.

I had a Tonic .to for a few years, did well with it, then sold it for good money. I know Tonic won't give out any info about you which I liked at the time. For some reason the search engines also like it. Nope it doesn't have to be a .com to be a good name.

Directnic doesn't have an obligation to hold your hand, i don't know whether they tried to register it and were denied or they made their own call and didn't bother trying. Whatever - it makes no difference.

YOU had the option of trying to register the domain with another registrar and didn't follow up.

you have NO case.

No, Directnic denied me that option by not notifying me they didn't register the domain. They are liable.

They sold the service of domain registration and issued me a receipt. It was only much later when I did a trouble ticket to find out why the domain was not working that they said they didn't register it. In that time someone else got it at a different registrar. They should have immediately notified me that they could not offer the service that I had paid for.

Not only do I have a receipt, but I also have another domain registered the previous december with the same term that is part of the same TLD hierarchy....I certainly could win the Icann dispute.

I sent this thread to Sig, the CEO of DirectNIC and he sent the following back in ICQ

The one problem with registering "adult" .CN domain names is that the Chinese authority has given very limited specifics to their guidelines on which domain names are acceptible or not. They just delete them at will. After they delete a domain name they will let another individual register the domain name. We can only assume that down the road they will delete the domain name again.

The Chinese authority and Neulevel (the operators of the registry for .CN) refuse to provide refunds for these domain names once they are taken away. We have asked for more guidance from Neulevel. However, none has been provided.

The only thing we can perform is to inform our customers of the principles prescribed in the Constitution of the Peoples Republic of China. This information has always been made available to our customers and is included online at http://www.directnic.com/legal/cn_addendum.php

6. Prohibited Uses for .cn domain name. Registrant may not register or use a domain name that is deemed by CNNIC to:

Be against the basic principles prescribed in the Constitution of the Peoples Republic of China ("PRC");
Jeopardize national security, leak state secrets, intend to overturn the government, or disrupt of state integrity of the PRC;
Harm national honor and national interests of the PRC;
Instigate hostility or discrimination between different nationalities, or disrupt the national solidarity of the PRC;
Violate the PRC?s religion policies or propagate cult and feudal superstition;
Spread rumors, disturb public order or disrupt social stability of the PRC;
Spread pornography, obscenity, gambling, violence, homicide, terror or instigate crimes in the PRC;
Insult, libel against others and infringe other people's legal rights and interests in the PRC; or
Take any other action prohibited in laws, rules and administrative regulations of the PRC.
So if you e-mail me your information, I will personally make sure someone looks into this, and find out what happens. I hope that if it turns out to be a mistake on your end, that you offer a public apology. DirectNIC has worked very hard to create a great brandname, by offering a quality product with great customer support for a fair price!

I just wanted to come back on this and set the record straight and what has evidently happened with our domain.


1 - It appears we did get the domain. We were told it was rejected by Directnic support when we did a trouble ticket to find out why it wasn't resolving, but either they didn't check it or the cn registrar subsequently changed their minds. It is resolving now.

2 - The domain I saw in use by someone else was not my domain, but rather a 1 character miss spelling on my part.

I would like to apologize to some extent to Directnic...In general I have been flying off the handle here far to easily due to the increasingly claustrophobic environment imposed on adult webmasters. I have roughly 100 domains at Directnic and in general they are the best tasting registrar.

Even better is that Michael (MikeAI) is actually one of the owners of Directnic and he followed up on this

Directnic's my third registrar and it's by far the best!

I don't know if DirectNIC was the register but this was a big deal a month or more ago. She was posting on all boards because her domain was stolen and she couldn't get it back.

Is there a way to "lock" domains with DirectNIC? I'm looking to consolidate about 30 domains under a single registrar and I want one that will contact me before any changes / ownership is made.

WG,

You can lock all domains at once with Directnic very easily. I never had any problems with directnic. Once something went wrong with registering some .tv domain and it was resolved quickly. They have a good support.
