No, Directnic denied me that option by not notifying me they didn't register the domain. They are liable.
They sold the service of domain registration and issued me a receipt. It was only much later when I did a trouble ticket to find out why the domain was not working that they said they didn't register it. In that time someone else got it at a different registrar. They should have immediately notified me that they could not offer the service that I had paid for.
Not only do I have a receipt, but I also have another domain registered the previous december with the same term that is part of the same TLD hierarchy....I certainly could win the Icann dispute.
