Nope, the idiot is the one who created that add "no background checks before 8Am". Because that means exactly that - you won't be checked (as you will be able to buy it without check).

You can buy the gun any time you want, that does not mean you can take it home because background checks are not available 24 hours a day. This actually worked to my advantage on Christmas day, sometime in the early 90's.
