My thoughts are on people who offer an affiliate program to webmasters, yet use a 3rd party processor. If the processor is the one that sends out the cheques to the affiliates it makes it nice and convenient for the paysite/program owners of course..... BUT ---- What happens when for some reason the processor DOESN'T pay anyone?
The program/paysite owner ALSO doesn't get paid. Okay, fair enough, except for this...... Where is it written in the affiliate aggreement/TOS that the affiliate will only be paid if the processor pays? I guess my question, in a nutshell is this...... I as an affilate of "somebody's-paysite-cash" sent my hard-earned traffic to them and got them some signups and money was made by someone. The sponsor offered me (the affiliate) a certain amount of money or a % of each signup. Is it the affiliate's problem that the processor didn't pay? Q: Should the sponsor pay their affiliates regardless of what the processor does? Affiliates rarely have the choice of what processor to use (exception would be Oxcash who offers a choice of 3) so...... what's the correct way to look at this shit? I'm inclined to think that the affiliate should be paid, period, whether it is by the processor or the sponsor. What do you all think?

Fascinating.

There was this exact same thread yesterday, i say the affiliates are still owed the money by the program should they have a problem with the processor UNLESS it's CLEARLY stated in their Terms and Conditions otherwise.
But let's face it, this is a moot point, if a processor goes under on a revshare program, either the program owner doesn't have enough money to pay what's owed to his affiliates or he'll run and hide or tell you that you are his 'partner' and were subject to the same risk he was.

Yet there are exceptions. Not quite the same scenario, but look at Maxcash about 2 years ago or so.... big mess of a court battle, their bank accounts on hold, affiliates waiting for their payments. Anyone remember this? Fact is, Maxcash made good on EVERYTHING THEY SAID, they did make people wait a few months, some more than others, but everyone (including me) got paid in full. I didn't hear them once complain about it either, or try to run and hide or blow anyone off. Yes, if only all programs had half the onions of Maxcash. I'm sure there are others that would make good on money owed under processor difficulties though, I can name several that I have a lot of confidence in.
