I dont want to sound like an ass but, thats really not my concern. When I signed up to the proggy nowhere in the TOS did it say "we will pay you only if our processor pays us. Nowhere did it say, "if we get fucked , so do you"

It did however say "Payments are mailed each week. There is a minimum check amount before a partner will receive a check. The partners will receive a check once their total equals or exceeds the amount of $25.00.

Checks are mailed out to partners once a week on Wednesdays. The pay periods are from Monday thru Sunday of each week. There is also a one-week delay in sending partner checks to them."

What do you think if one of the big boys like Nasty or Topbucks Lose a processor would do? They would have paid us in any fucking event, any event.

This is the second time in 4 months I have to deal with bullshit like this. In december I was issued $2500 of bounced checks and $2000 of late checks. That matter has now been fixed.

New problem: I have not been paid for 371 sign ups and I want my fucking money, weather it be from WSB or my sponsor.

Im sorry if I sound upset, thats because I am. I fucking am. Maybe now being called a "shit disturber" can be justified.

amen

Ray is right I think. Revshare doesn't mean 'if everything goes right with our processor and we get our money we'll split it with you 50/50'. It means you get 50% of the money generated by your traffic. Whether the check is sent out by the third party processor or not doesn't matter. Unless somewhere in their terms and conditions they've included some other language which explicitly says 'we only pay out commissions from monies received from Website Billing'.

I think others will reply on this thread that the affiliates assume the same risk as the program operator when they sign on as a 'partner'.

It would be an interesting legal case. Any armchair lawyers wanna speculate how a judge would decide a case like this?

What does the affiliate agreement say on these issues?

I assume you mean the bounced checks. I cant say who, reasons being 1- I gave them my word I would not say anything, and 2- apparently it was a banking error.

Too much fucking bullshit latley. In 4 months I had to contact my lawyers 4 times. Fucking 4 times! Bad checks, late checks, stolen content, hotlinking. Its turning to shit boys.

This is what I was referring to
"New problem: I have not been paid for 371 sign ups and I want my fucking money, weather it be from WSB or my sponsor. "

That is a lot of coin. Can't your sponsor afford to pay you? Or are you hoping WSB gets back in biz? Remember DMR?

I'm waiting until the 15th which is 30 days late. I'll do a letter of demand and then if that goes nowhere I will get it enforced in court here. I believe that I am entitled to the current lost amounts and also a portion of future lost income.

Generally everyone expects to be ripped off and does nothing about it. But in the past 6 months I (and a few others it seems) have had their asses kicked so many times it's just not tolerable any more.

I am fucking furious about this...More so about the BS and total lack of any binding guidance on this issue than the money.

Processors fall within the same laws as any other company or indiviual. If they owe money, then they are obligated to pay it.. If they are late paying it, then penalties and interest can be applied. These are non-contractual laws.. meaning that you don't have to have a contract that specifies such.

Don't be afraid to haul their ass into court to get your money.

But.. WSB promised to pay by this past Friday. Give the mail a few days to get there, then react accordingly.

Jumpin up & down on the boards won't do a thing to help.. Either take action or walk away..

Know of any collection agencies who collect for Overseas clients? From Australia it's just not worth the hassle of legal action for only a few thousand dollars, but I want the money owed.

Do they have debt collection agencies which work for a %fee over there in the US (UK???). Just interested, because this is getting beyond a joke.
