I was wondering when the courts were going to figure out that "electronically reading" of private communications was still reading of private communication.

I would normally think that google would lose this one hard; but they have been able to do a lot of things that I would never try. So I can't bet how this one will turn out.

Yeah, I read about this, yesterday. I think Google won't even be shaken at all.
They run the internet and have endless funds. "Two federal judges have ruled
that both cases can move forward, despite Google's protests."

I wonder what the payoff price is for both of those judges....

I don't know about the price because the price can be zero. It's like the judicial attitude is that google is an exception to certain rules.

So... If when we sign up to Gmail and agree to their terms and services that gives them all the rights to fuck us in the ass and read our email, that's not enough of a disclaimer?

gmail users may not have a case due to the TOS. However, the courts should look at emails sent from non-gmail accounts to gmail accounts, as those people never authorized Google to read their emails.

Like the post above said : I can't agree for the person that emails me from yahoo mail.

Further, the courts can consider the reality of a TOS; meaning that no lay person can be expected to truly understand one. Also, what does a TOS mean in foreign countries?
Much of the TOS can be totally illegal in the country of a particular user.

Furthermore, illegal agreements are not enforceable and no one has ever proven that a person can legally agree to such services when it comes to email exchanges with a third private party.
