Girl Gets Locked Up For Saying LOL on Facebook

The judge presiding over Asher's case found little humor in a crime that results in, according to the National Highway Traffic Safety Administration, 28 deaths each and every day. Asher was ordered to shut down her Facebook page as a result, and when she refused, the judge held her in contempt of court and had her thrown in jail for two days.

Asher's told her local NBC affiliate, "I didn't think LOL would put me in jail."

Am I missing something here? Did I read the article wrong or something? This girl got 2 days in jail for simply writing her opinion about her DUI crime online? I never knew it was illegal to say "My dumbass got a DUI and hit a car LOL," what law is there against that? Thought the 1st Amendment guaranteed us the right to freedom of speech and expression?

I'm definitely missing something here... what was the court order that she did not obey? After she got done with her DUI trial the judge told her she isn't allowed to say anything about it on Facebook, or what?

Because she's on probation. Let me explain probation to you real quick. In America, when you commit a crime you go to jail. Some lucky people can convince the court to not put them in jail, and instead get probation. Probation means "We're being EXTREMELY nice and not letting you sit in a jail cell. But you have some rules to follow while you're out there".

People seem to think probation is punishment. No, probation is someone getting to do their sentence outside of a jail cell with very strict circumstances.

Also, while in jail and on probation. You do not have all your normal rights. Just like a prisoner doesn't "have the right to facebook", if the judge decides you aren't keeping up the morals he would like you to while on probation and wants your facebook page removed for the remainder. You do it, or you go to jail. That's how probation works. If she didn't want to be on probation and live by the judge's rules, then she could have just sat her happy ass in jail from the beginning.

Probation isn't punishment. Probation is a reduction of the crime you are serving time for. It's getting the chance to be leniently treated with restrictions vs sitting in jail.

Exactly. Your punishment is still jail. Probation just let's out "out of jail" so long as you adhere to some very strict rules. You disobey those rules, you return to jail.

I just read the article again, and I don't see anything mentioned about probation. I haven't been arrested for DUI before like most of you so I don't know how that process works.

All I know here is the article says "Asher was cited by police for driving under the influence" and then after that she was told by the judge to shut down her Facebook page and when she refused she was held in contempt of court.

Apparently when you're on probation for a DUI you are not allowed to speak about it online. This I did not know.

You can speak about it online and being on probation or not being on probation does not have much if anything to do with it. What you cannot do is defy an order by a judge unless you are willing to pay a consequence for doing so.

In this case, to me, the judge was out of line. Clearly he didn't like what this person wrote and was pissed off about it. Just curious where you are getting that she is on probation. The article says nothing about that. It says she was cited for DUI. It doesn't even say if she was convicted or not. Just getting sited for DUI does not put you on probation you have to be cited, go to trial, lose and receive probation as a punishment. None of this is stated in the article. Do you know something the rest of us don't?

Maybe the judge was out of line and maybe he wasn't. There have been many cases where judges have...for whatever there reasons...ordered people to not access the internet at all...let alone kill a site/account.

There is a saying among attorneys that the law is what the judge says the law is...so yes...a judge can take away what you may consider to be your constitutional right. That is the reason why they have multiple appeal courts...with the Federal Supreme Court being the ultimate appeal Court.

One can appeal a judge's decision/order (which is usually very expensive to do) but in the meantime one has to comply with the decision/order...unless one can obtain an injunction against the order while you appeal the decision/order.

she actually got locked up for admitting to a DUI and the judge did not find it humorous that she was "laughing" about getting one.

imagine killing someone and then while your defense is arguing a case about you not really meaning it, you started laughing out loud in the court room... no one would have sympathy for you and nor should the judge for this whore

BEFORE you are being sentenced, you shouldn't be an unrepentant twat with a dismissive attitude about your actions and behavior which cause's 1000s of deaths of innocent people each year. I seriously doubt her facebook page was the deciding factor as she also had to appear in court. My guess, considering the fact that this world is now full of narcissistic, "me me me me me" dip shits is that she was probably late for court, didn't appear, was dressed like a whore, was disrespectful and so on and so forth drawing the ire of the court.

We all understand that you "hate the man" and think everything is about some bizarre prison state which exists in your own mind, but i'm going to go out on a limb here and suggest that the judge has better information about the case and the defendant than you do. BTW... you also seem to have a very poor or at least limited understanding of "Judge" and what a judges function is.

No the girl got 2 days in jail for refusing to do as a judge ordered.

Its a stupid ass order, but legally she has to comply. Then sue his ass and the state.

Yes, if you laugh out loud in court at the judge, mock the judge, mock the court system, or fail to follow any order in court... Yes, you can be held in contempt of court.

I don't understand people in court. Judges have a huge amount of power in court. You can go in for a simple traffic violation and end up in jail because you said the wrong thing to a judge.

Years ago in Phoenix I got a hefty traffic ticket, 100mph plus, mandatory court appearance. This was out in the desert outside of Phoenix where such speeding tickets were common. I was hot that day, but I dressed up in a suit and tie and slacks, etc. I was the only one in the court room dressed up - everyone else was in shorts and t-shirts. The woman before me had the same exact ticket. She wasn't dressed properly, was crying, yelling at the judge, and more or less "tossed" her paperwork at him. He nailed her to the wall, two thousand dollar fine, and suspended her driver's license. I got up there, everything was "yes sir" and "no sir", and when asked how I pleaded instead of offering up lame excuses I pleaded guilty. Women before me got nailed to the cross for the same violation; I got it dropped down to speeding 75mph in a 65mph, one point on my license, and a $120 fine.

See the difference? A little bit of respect goes a long way in the court room.

Yeah, the judge ordered her to take down her Facebook. And I think she deserves it. She nearly killed four people, and instead of taking it seriously she's laughing about it on Facebook. She's lucky she didn't kill four people, and she's lucky she's not in prison for the next ten years.

I think your right. This was less about what she did on Facebook and more about her general attitude towards the crime she committed. Obviously she's not taking it seriously.
