Complying with takedown notices in an expeditious manner is the bare minimum we require of sites.

Site owners are ultimately responsible for the content they host and will be held accountable for permitting systemic infringements.

Very few of the sites we have taken action against have to deal with DMCA. However this doesn't mean that copyright law is null and void.

Sites in every jurisdiction can face sanction for infringing content.

amazing - you can't buy a premium subscription to any of these big file lockers with Paypal now.

on the downside, i really don't think it will translate into an increase of sales to paysites. there are lots of factors that went into killing the paysite biz.

I used their contact page and sent a DMCA that way.
Images got taken down after a few days.
My upload monkeys have stopped using this shitty image hoster
Do they still use Paypal? Haven't looked for a while, they were using them though...

Thanks to everybody who has had some part in bringing down so many of the file lockers. We are a super tiny company, and produce some VERY niche content, so it hit us really hard. I just wanted to recount one story and show you something you might find...funny?

One of our big things is tickling. This guy was posting basically every video us and every other "major" tickling producer (as major as tickling production gets) would put out. Some guy who we think is in Russia. He went through a few different file lockers until he found the "best one" for being annoying to DMCA - MegaUpload (in his opinion). He got slowed down pretty hard by Degban, but kept going, but eventually when MegaUpload got shut down, he shut down for good - we thought.

He came back with a private torrent site, hosted on Ecatel (they don't give a shit about anything, much less DMCA) using public trackers.

I'm not sure if it's bad manners to post the link to his site - it's full of pirated tickling videos - but his hubris, and the outpouring of fawning thanks from his fans is so ridiculous I just wanted to show somebody:

EDIT: I removed the link because I'm not sure if it's allowed to post it. If it is, I'd like to -- his "About" page and comment section are ridiculous.

It starts "In the beginning of 2012 to all filehostings war has been declared. Megaupload has been destroyed by U.S. federal authorities."

As far as I can tell, there's pretty much nothing that can be done when videos are pirated like this. None of the private trackers that are used will do anything (of course), and things like torrent poisoning look way beyond the ability of anything but a major company with a lot of resources (like HBO did). At least torrents are more cumbersome...

Degban is the company I'm talking to right now to take care of my uploaded content. I heard they do a pretty good job.

It's like any crime, there's not way to completely stop it, all we can do is manage it.

It's extremely frustrating when it's one douche bag that's causing most of the problems. It's the 80/20 rule.

Loads of companies will charge you several hundred dollars a month for a computer to send out DMCAs. Will it make ANY impact to your sales? No.

Spend that money on improving your marketing, tour, testing, UX, customer service, anything really and you will see an measurable impact on your sales.

Sadly I factor in time to monitor piracy myself now as well as all the other duties I do on a daily basis, it really pisses me off when a couple of individuals can cause so much damage!

I'd rather spend the additional time marketing my site instead

I was doing this for awhile but it's just too time consuming and it's more cost effective to pay someone else to do the leg work. One company wants $400/month for both sites and another wants $750/month for both sites.

It chaps my ass to have to pay for something like this. AK seems to be making pretty good progress and it's not nearly as bad as it use to be but still an issue. I might wait it out a little while to see where things go with file lockers.

Just sending out DMCA won?t stop your problem. You need to get into your raw logs and weed out the offenders. Yes, it?s a lot of work and very time consuming.

don't want to spam this thread, but do want to let everyone know the good news: takedown piracy has removed its 10 millionth copyright infringement.

in addition, tdp is ranked by google as the #1 infringement reporter against the pirate bay and most tube sites.

thought this was pretty cool info. i'll post more in the announcements section if you want to read.

And there's probably been 20 million to replace them.

DMCA is a circular process that does not cut to the core of the problem.

DMCA has it's place but is like putting a bandaid on a deep wound, it's also expensive for rights holders and after one year of using a DMCA agent the rights holders are in pretty much the same position as they were when they started.

It seems Netload have added credit card payments to their payment options, insecure, non SSL manually processed credit card payments.

Basically they accept credit card numbers into an insecure form with no sanity or number checking and then try to manually process them.

If that is actually the case I think you can report it to visa or whatever card they take and get them investigated or fined for lack of pci compliance

Providing they have a merchant facility in the first place, it's more than likely these card transactions are being processed through some other entity. We should know more about that in a few days.
