Judge O'Grady raised the prospect of there being no trial while hearing arguments over FBI applications to wipe Megaupload's vast database of members' files.

He said further study needed to be made of the failure to serve Megaupload, adding; "I frankly don't know that we are ever going to have a trial in this matter."

He said the arguments around the future of the data on the 1100 computers servers seized from Megaupload could be "premature". He wanted more information on why Megaupload had not been served.

Dotcom's US-based lawyer, Ira Rothken, said it was the defence's understanding that it was not legally possible for Megaupload to be served with papers accusing it of criminal acts.

I'm pretty sure I postded somewhere on gfy that this case was anexample to show why sopa was not needed.. it shows perfectly how the government can go after anyone anywhere when they wish to do so but even that doesn't guarantee guilty.
This is a perfect example to show why sopa could be bad for anyone against sopa.

If they wanted to demonstrate by example they could have taken out 100s of sites for the same cost AND gotten easy convictions because people could not afford defending themself

I don't see anything to respect in regards to Kim Schmitz. We can all take part in illegal acts, we can march right into Nordstrom and steal everything on the shelves and sell everything in front of their doorstep for 10% of their cost... and rake them over the coals. I could only wish it was so, but the reality is that MU type of sites blow with traffic overnight whenever they're put online - if Dotcom walks free on procedural error and gets his domain back he'll recover his traffic and cash flow in no time.

The government argued that you were only entitled to safe harbor if you destroyed the original file rather then infringing access.

If true would mean that the only way a back up provider could keep safe harbor was to destroy your backup rather then simply change the password (access).

60% of the files were only download 1 or less (clearly backup)
