Judge O'Grady raised the prospect of there being no trial while hearing arguments over FBI applications to wipe Megaupload's vast database of members' files.

He said further study needed to be made of the failure to serve Megaupload, adding; "I frankly don't know that we are ever going to have a trial in this matter."

He said the arguments around the future of the data on the 1100 computers servers seized from Megaupload could be "premature". He wanted more information on why Megaupload had not been served.

Dotcom's US-based lawyer, Ira Rothken, said it was the defence's understanding that it was not legally possible for Megaupload to be served with papers accusing it of criminal acts.

I'm pretty sure I postded somewhere on gfy that this case was anexample to show why sopa was not needed.. it shows perfectly how the government can go after anyone anywhere when they wish to do so but even that doesn't guarantee guilty.
This is a perfect example to show why sopa could be bad for anyone against sopa.

If they wanted to demonstrate by example they could have taken out 100s of sites for the same cost AND gotten easy convictions because people could not afford defending themself

I don't see anything to respect in regards to Kim Schmitz. We can all take part in illegal acts, we can march right into Nordstrom and steal everything on the shelves and sell everything in front of their doorstep for 10% of their cost... and rake them over the coals. Pro-piracy douches will have our backs saying "this shit should be free..." and "the only reason we're doing this is because of corporate greed..." and we'll garner the support of everyone who opposes government regulation.

I'm sure we'll be the envy of everyone poor person on earth who's ever felt like they got the short end of the stick when it came to the economic gravy-train. Does that mean we should stoop to that level?

They already ruined him. This was all done so people bought into apples cloud system and soon googles.

They delay him another 2-3 months its irrelevant anyway. Hes lost the income, lost the servers, lost his clients, etc etc

if he really did offer content owners the ability to go in and delete files themselves, then a case against him based on just the service being used for piracy is pretty weak. Otherwise we'll have to sue ISP CEOs for what people do on their network!

People use cars to kill other people all the time, or knives. We don't arrest car manufacturer CEOs, but go after the person who does the act. No difference

There's something to be said about the artists who support(ed) him and the timing of the raid right before he was going to launch a music label that would've turned the industry on its head

This shows clearly that the old laws on copyright infringement are not working as far as the Internet is concerned.

Either Governments give up on protecting copyright or they really sit down and think of ways they can curb it.

Giving up of course means a huge loss of income for creators.

I could only wish it was so, but the reality is that MU type of sites blow with traffic overnight whenever they're put online - if Dotcom walks free on procedural error and gets his domain back he'll recover his traffic and cash flow in no time.

do you understand the difference between something that is proven to be illegal
and something that is claimed to illegal

that case was weak to begin with

The government argued that you were only entitled to safe harbor if you destroyed the original file rather then infringing access.

If true would mean that the only way a back up provider could keep safe harbor was to destroy your backup rather then simply change the password (access).

60% of the files were only download 1 or less (clearly backup)
