Usually there is an age difference specified in this type of law ... Like five years age difference, e.g.; a 14 year old girl and a 19 year old boy. |

 What is the legal age of consent to have sexual intercourse in California? 18 years old. This means sexual contact with a minor under the age of 18 is illegal in the state of California even if the minor says it is consensual. Is it OK to have oral sex with someone under the age of 18? No. It is not legal.
