Appeals court rules against Obama healthcare law

WASHINGTON (Reuters) - An appeals court ruled Friday that President Barack Obama's healthcare law requiring Americans to buy healthcare insurance or face a penalty was unconstitutional, a blow to the White House.

The Appeals Court for the 11th Circuit, based in Atlanta, found that Congress exceeded its authority by requiring Americans to buy coverage, but also ruled that the rest of the wide-ranging law could remain in effect.

The legality of the so-called individual mandate, a cornerstone of the 2010 healthcare law, is widely expected to be decided by the Supreme Court. The Obama administration has defended the provision as constitutional.

The case stems from a challenge by 26 U.S. states which had argued the individual mandate, set to go into effect in 2014, was unconstitutional because Congress could not force Americans to buy health insurance or face the prospect of a penalty.

"This economic mandate represents a wholly novel and potentially unbounded assertion of congressional authority: the ability to compel Americans to purchase an expensive health insurance product they have elected not to buy, and to make them re-purchase that insurance product every month for their entire lives," a divided three-judge panel said.

Obama and his administration had pressed for the law to help halt the steep increases in healthcare costs and expand insurance coverage to the more than 30 million Americans who are without it.

It argued that the requirement was legal under the Commerce Clause of the Constitution. One of the three judges of the appeals court panel, Stanley Marcus, agreed with the administration in dissenting from the majority opinion.

The majority "has ignored the undeniable fact that Congress' commerce power has grown exponentially over the past two centuries and is now generally accepted as having afforded Congress the authority to create rules regulating large areas of our national economy," Marcus wrote.

Many other provisions of the healthcare law are already being implemented.

The decision contrasts with one by the U.S. Appeals Court for the 6th Circuit, based in Cincinnati, which had upheld the individual mandate as constitutional. That case has already been appealed to the Supreme Court.

The Court of Appeals for the 4th Circuit, based in Richmond, has yet to rule on a separate challenge by the state of Virginia.

Auto insurance is a pain in the ass, but you can always choose to not have a car. You can't choose to not be alive (well, I guess you can.) Auto insurance is also usually cheaper than health insurance (not always the case, but usually.)

Ummm... auto insurance isn't required if you don't drive a car ... driving on public roads is not a right, it's a privilege. You can drive all you want on private property with no insurance that's your right.

No you can't.

Everywhere I have lived required you to have a license plate on any car on your property. If not it was considered "junked" and to be towed away.

So to get a tag...guess what you have to buy: Auto Insurance

Not saying that anybody would really WANT to have a car that they only drove around their yard...but just saying that the govt. always finds a way to fuck you over and hold hands with the insurance company in both health AND auto.

How the fuck do we get mandatorily taxed for Medicare but somehow that's not mandatory payment for healthcare.

But since people can be unemployed and the purpose was to make sure the
unemployed were insured; the plan couldn't work thru a payroll tax.

Also, mandatory buying insurance is the only way to get this program
without raising taxes.

If Obama raises taxes for HC insurance then he's called a "socialist".

my point is that a lot of people complaining about forced/required healthcare are the same ones that go to the ER whenever they get sick and they do it on my dime...

the healthcare bill should be thrown out.. the only good that came out of it was forcing insurance companies to take people with pre existing conditions...

this country needs affordable healthcare for low income people and families and thats a fact..

how we get there is always going to be fought about...

Carbon is not the problem, it makes up 0.041% of our atmosphere , 95% of that is from Volcanos and decomposing plants and stuff. So people in the US are responsible for 13% of the carbon in the atmosphere which 95% is not from Humans, like cars and trucks and stuff and they want to spend trillions to fix it while Solar Panel plants are powered by coal plants

I don't know why I bother to try and explain things to some of you. This isn't really a topic to be debated it's common fucking sense. I'll try anyway, although it's going to fall on deaf ears.

You can't insure criminal acts. If you knowingly give somebody AIDS, that's a crime. Your health insurance doesn't cover any liability. Same holds if you drive drunk, your car insurance won't cover that either.

No, this country needs affordable healthcare and prescription medication for ALL people and families.

It wasn't that long ago that you didn't NEED insurance to go to the doctor or even if you were hospitalized. But we have all been ass raped by the govt. holding hands with the medical industry and the insurance industry.

We pay many times what other countries pay for the same thing. (and no, I'm not referring to third world countries either). Our medications are price gouged unbelievably too. It's a goddamn disgrace is what it is.

And Obama walked right in the White House and the FIRST thing he did was cut a deal with the prescription drug industry and insurance industry to guarantee that they could continue to overcharge Americans for health care.

There is an entire industry of "medical tourism" because you can go to a first class hospital in India for instance...and have surgeries done for 1/10th or less the cost of the same exact thing here in the U.S.

I'm sick of getting bent over and fucked by the govt. and insurance companies.

I've told this story before...I'll tell it again: In 2002 I had no health insurance. Hell, I was always healthy and I never get sick. Then I was in a car accident and broke my neck.
Spent a couple of weeks in ICU and a month in the hospital.
At the end of it...they sent me a bill for over half a million dollars!

So we began "negotiating". Then they turned me over to collections. I had just got home and my neck was in a hard brace and both arms were in full arm casts and I was scrambling to catch up on all my work on the net. Things were looking pretty bad.

And then...after a few weeks...the company that owned the hospital where I was treated called me on the phone.
They told me they had "reviewed my case", and since I did not have insurance they were not going to charge me the "insurance price" for my medical care!

Basically...the cost went from over $500,000 down to $22,000 and change.

I almost cried tears of joy when they told me that.

So I asked: "How can that be?"

And the lady told me that they have pricing for people with insurance and then the REAL cost for people without. I kinda chuckled and said that was a pretty good scam. She told me matter-of-factly that it was how "business is done".

Somebody with some BALLS needs to get into Washington and end this fucking insanity of falsely elevated health care costs. The insurance companies and medical industry and big pharmaceutical companies are fucking us hard.

I keep seeing people try to make the connection between car insurance and health insurance,

The only connection between the two is the word "insurance" in the names

So for (hopefully) the last time...

The Federal Government cannot compel you to buy auto insurance, it's the States that require it not the Federal Government.

The Federal Government is trying to compel you to buy health insurance, not the States

And not all States even require auto insurance, I believe you don't need auto insurance in New Hampshire for example.
